Been looking about the forum for a little while now bit confusing but think i have got the gist of it, sent my first letter to my local branch on 11/01 requesting my statements over the last six years for two accounts along with a cheque for £10. So i guess its just a case of being patient now given them the 40 days to respond. Will post again once they arrive and post on every stage of my claim let you know how how i get on and if i need any help and advice as im going all the way for a full refund on all charges on the 2 accounts.:)

Yes all your can do now is sit and wait for your statements - but while you are waiting read as much as you can on here, the halifax threads will soon start to show a pattern. The more informed you are the more confident you will be and everyone is here to help you.

Noticed the halifax have put in my account £10 cheque today, still no response from them so will sit tight till they get in touch.

 

11/01/07 - Data protection act 1988 - Subject Acess Request template sent to local branch first class recorded delivery along with £10 cheque.

 

23/01/07 - Bank put cheque into my account.

2/3/07 - Finaly recieved all bank statements.

12/3/07 Prelimary aproach letter sent.

22/3/07 - Reply from bos reading - Thank you for your recent complaint we are sorry to learn that you are unhappy with the charges debited to your bank account. Please note the complaint handling rules set by our regulater, the financial services authority, gives us 8 weeks to investagate and respond to complaints. Our commitment to youis that we will respond to your concerns at the earliest opportunity. However we want to ensure the issues you raised are thoroughly investagated. If, for any reason we are unable to respond fully to your concerns within the next four weeks we will write to update youof our progress. You will find enclosed a copy of our leaflet, which tells you how we will handle your complaint. yours sincerly bla bla

Give them a ring and chase them up, it looks like you are getting quite close to the 40 days so let them know if you do not receive all your statements you will be contacting the information commissioner.

Thanks for this posting, Josamolly. I have just joined CAG and am about to embark on the process with Bank of Scotland. Your links have answered the questions I was concerned about - especially the Scottish element to claims. I'll start my own little thread when SAR sent.

Finally Recieved statements in full, been going through them £2500 with 3 years statements to go, just been reading the interest calculations sheets and other posts! on my statements from HBOS it just lists charges as notified on the sheets, What rate should i charge the interest on each individual charge is it 8%

u dont charge interest til u serve MCOL

 

Hi, on the prelim approach letter, it has overdraught interest, how do you work this out as my statements just read charges as notified? Anyone got the link for the spreadsheet to send of with the prelim approach letter.

Most people do not bother claiming overdraft interest, so just take this bit of text out of the prelim letter. Go to the template library, then click on spreadsheets, all you need is there, try the England - Simple - Excel.

Just got letter back from bank, says i will have to wait upto eight weeks till they look at my case. Take it this is a new thing by the hbos? Also just read you can only claim £750 in scotland is there a way round this as im well skint and wanting the full whack?

Hi JJ:)

The 8 weeks to look into it is normal-just carry on with your schedule sending LBA after 14 days.

Have a look at the Scotland forum,you can claim in England if you have an English address ,PO BOx for correspondence but you would have to be prepared to go there if it went to court.Because of multiple claims being thrown out at some Scottish courts then some advise claiming through FOS.

Thanks for your reply have posted the reply letter recieved from the bank at top of page, take it this is a standard letter then? Has the bank got a rite to hold out for the 8 weeks, Do i wait give them this time or just start proceedings now as there 14 days are up monday. Been reading a bit about small claims my claims for £2679 not including interest, want to take them to court for the full amount plus interest. I'm easy if this costs a few hundred quid, also easy about going to court will get it all back anyway. Just a bit confused about the process for a claim this amount. Any links on the procedure or help if anyone is reading would be appreciated. I'm choking to get a bit action going lol. Keep the faith people and keep on keeping on!!!!!

Normal letter that we all get.

Yes, keep to YOUR timescales(Monday) as they will try and fob you off time and time hoping youll give up..trying to go faster than the 14 days might mess your claim up so be patient.

Have a look at my thread.Halifax have foned me this morning offering full amount which was 6 years! (no interest cos I am 1 day off court action!!!)but this is what theyll do-keep you till the last minute.So 14 days after Monday you could be getting a phone call!Hope you do .Glad you're keepin on, cos its worthit!

Recieved Letter from bank today, saying they recieved my letter of complaint, and will be back in touch no later than the 16th of may. Thats the date there 14 days are up from the lba letter. Should i phone them up monday or just go straight on with he court process?

Just carry on with court when the 14 days are up.
