    • understand that HB, yet much of it that has 'come out' seems smoke and mirrors - like the pointing at and questioning of data clerks   the core issue remains the same Who set these practices, and hid the known data issues? Vennells obviously presided over it and has no excuses - but those gov board members effectively were her bosses - representatives of the shareholder. I would welcome comment.   Dear Yodel, Claimant x: claim for breach of contract loss of package xxxxxxxxxxxxxxx I am making a claim against you claim against for breach of contract relating to your loss of a package valued at £150.00. I refer to two webchats that I have had with your organisation following which I was advised that Yodel were not prepared to recompense me for my loss. This letter is being sent to in accordance with the Practice Direction on Pre-action Conduct and Protocols (the Pre-action PD) contained in the Civil Procedure Rules (CPR). In particular, I refer you to paragraphs 13 to 16 of the Pre-action PD concerning the court's powers to impose sanctions for failing to comply with its provisions. Ignoring this letter may lead to our my commencing proceedings against you and may increase your liability for costs. Circumstances leading to my claim against Yodel On 14 June 2024, I made a sale on eBay of a set of 3 Kirkland Signature golf wedges (‘the goods’) at a price of £150.00 plus £6.00 postage. I received payment from the purchaser via eBay and on 15 June I purchased postage from eBay’s Packlink. Packlink arranged the delivery of the package to the purchaser with Yodel. Having packaged the goods in wrapping paper, I delivered them on 15 June to the Shell petrol station on ……..and a tracking number of  xxx was given. Tracking showed that the package made it to your Leeds Depot on 15 June but thereafter the package went missing. The Purchaser had been advised that they were ready for collection at her local depot in Preston but they could not be located in Preston. I personally attended your Leeds depot where your helpful staff confirmed that the package had been scanned into that depot and was also scanned going onto one of your trailers (7DL 1436) bound for Preston but that thereafter the package was not scanned again and could not be located either in Leeds or Preston. Due to non-receipt of the goods, I was required to refund the buyer her £156.00. I have sought compensation via Packlink but they are only prepared to pay ‘basic compensation’ of £25.00. Through your webchat I have sought to make a claim against Yodel but have simply been referred back to Packlink suggesting that I do not have any rights against Yodel. You are referred to the The Contract (Rights of Third Parties Act) 1999 upon which I rely and which give me the right to sue on the contract just as if I was a directly contracting partner. I was a discernible beneficiary of the contract entered into by you with Packlink to deliver the package on my behalf. As the sender of the parcel I was somebody who was intended to benefit under the parcel delivery contract. In breach of contract, you failed to exercise reasonable care and skill to deliver the package to the purchaser but instead have lost the package. Given the scanning history of the package, it is likely to have been misappropriated whilst in your custody – a failure to take reasonable care to avoid such misappropriation.   My Claim against Yodel I wish to claim the sum of £150.00 being the value of the goods lost by Yodel   Relevant documents I enclose copies of the following documents that are relevant to this matter: 1.    A screenshot of the eBay sale of the goods and the tracking notes.   Alternative dispute resolution I am prepared to consider ADR.   I  look forward to receiving confirmation that accept liability for these matters, together with a full settlement of my claim, within [21] days of the date of this letter, namely by [DATE].] [In the absence of a full response by that date, I will issue and serve proceedings without further notice.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hello to the lloyds tsb forum.

 

i shall be claiming back my charges for 2 personal accounts and 1 business.

and have opened a new account. i am currently finding out the totals for each account and then decide on which action to take ie do i claim for them individually or all together. i suppose that depends on total ammount and how much i can get back.

 

any one with advice please tell

Hi Smudge, welcome on board!

 

Firstly how are you finding out the totals for how much Lloyds have taken from you? Have you requested copies of your statements for each of your accounts over the past 6 years? Or are you using your own records? I would advise requesting your statments from Lloyds (if you have not done this and want to then please read the stickys and step by step guides here within the Bank Action section).

Also I believe from other threads that the wording differs in the case of the business accounts (although not sure if that is for the preliminary letters or at court claim stage off the top of my head! - again please read above stickys/ threads).

If you wish to (should you need to) make a claim against Lloyds through the small claims court then you are restricted to £5,000.

I would separate business and personal accounts - but if there are any MODS avail to help.....please step in!!

Good luck smudge ( and definitely spend some time reading other people's Lloyds claims incl. business ones, you can learn so much that will be helpful!)

i am going to claim on each account seperatly as my business account will be above £5,000 alone and it is likely to be above £2,500 for each of my personal accounts. i will tell all real figures once i have used lloyds excellent service of telling me how much they have actually tacken its cheaper to let them do it.

 

but i shall use the full ammounts as scare tactict and only claim up to £5,000 for each account. unless i find threads wear people have gone the full hog and won i suppose i could be persuaded

Just a thought Smudge,

I read back in the summer through this site that in order to keep the claims below the £5,000 mark (in order to keep the claim within the realms of the "small claims" division) that you could make separate claims say for example Unpaid Direct Debits and Unpaid Standing Orders. After all, you should claim for EVERYTHING which Lloyds have unlawfully taken from you!

I think that there is a separate sticky for cases won, but I am not personally familiar with big claims which have been successful. I am sure that there are!

Presumably then you have sent your £10.00 fee per account for your Subject Access Request (SAR) from Lloyds in order to receive all the relevant charges applied?

my business account charges are £4,390 without interest this will take my claim over £5,000 . These charges are split between fee for unpaid item, fee for unpain cheque and unauthorized borrowing fee. the banks have catagagoriseied the charges not me but will this allow me to split into two claims or if i go down this route should i split into three if any one can put me onto a good thread please yell.

Smudge, firstly which interest are you referring to when you say charges are £4,390 without interest? Do you mean the bank's interest which they have applied upon your charges/overdraft?

If you could clarify that point that would be helpful!

Also there should be no need to split your claim into three, as the idea of keeping any claim under £5,000 relates to the court stage, and the ability to have your case as a small claims track, which is the most simple procedure. It may be worthwhile reading some of the notes from the moneyclaim website, which is www.moneyclaim.gov.uk

no i havn,t quit but hit a bit of a hurdle. I cant open another account bad credit history mainly due to the banks conducts. But I am still on shcedule with other accounts.

 

account 1 LBA ends 22nd of march £368.00

account 2 sar due 2nd of april

account 3 sar due 2nd of april

account 4 need to open another account £4,665 (still growing)

 

as to your questions this ammount is the charges only i havn,t worked out overdraft interest due to charge as in most cases this would only be one day. but the 8% that could be added would far exceed £5,000. i really need a new account and i will get cracking with this account even a basic one would do just to cash cheuqes.thanks for keeping faith smudge

i have now completed my mcol and sent 2 coppies of charges and interest to the courts manager for account no 1. this is where it starts getting interesting hopefully they don,t reply before 16th of april but i reckon they will ask for the statutory month

i am still a little unsure about my business account and where i stand with interest and the small claims procedure.

 

1 if i add the 8% interest to the ammount and this takes it over £5,000 will i still be able to go fast track. i have read that you can still apply even if above as it is the judges decision how far over is the question i suppose.

 

2 can any one shed some light on breaking down the claim into type of charge.

 

3 and im still finding it hard to open another account surely becuase we almost depend on banks to do our daily lives they must have to provide us with bank accounts.

If it is £5000 before the interest is added it will not go to fast track, it is the amount before interest that counts.

lloyds have acknoledged my claim i am now in the capable hands of SC&M. I am using mcol so i have now sent details of charges to them and i now wait 28 days for a response.update you soon

If still applicable can you break down the charges between overdraft excess fee, returned direct debits, and returned standing orders for example. I think that Barty helped you out regarding the £5k limit, but just in case account 4 is difficult to break down...(but not sure if you have started this one yet because of point 3 below?)

Is this a business account that you are trying to open? I think that over the past few months there have been a lot of discussions and threads regarding banks closing people's accounts (personal as far as I have seen), and that it may be useful for you to browse the Alliance and Leicester bank charges forum, as they were fined for closing accounts. So it still may be beneficial for you to start your claim but please read around and make your own decision!!

I must admit that I have struggled to open another business account elsewhere, and the annoying thing is, I only wanted an account in a company name, no cheque book, overdraft, loan, credit card (maybe thats why I keep getting refused though cos they wont make enough money out of me!! He he)

have opened a step account with natewst even though i had tried to open a business account previously and been refused. So i have sent of my prelim for my business account i shall bank through natwest untill they complain to many transactions are taking place at which time they will upgrade my account to a business account. thanks barty 5k before interest is added is good news lucky i found this website in time.
