      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone not been on for a while, but now i am back and since november my last post i have recieved a whopping £300 in charges and now my full amount i am chasing is in the region of £3700 . I just sent my Data Protection SAR Today so they should recieve it tomorrow so i presume my 40 days start from 10/01/07. please correct me if i am wrong

Hi everyone just to let you know that today 16th january 2007 Halifax have cashed the £10.00 cheque i sent with Data Protection SAR but no sign of statements, but it has only been 6 days , just so excited at the prospect of recieving them to tot up what they owe me in UNLAWFUL bank charges.

Hi Guys

Sent off SAR on 10th jan just recieved a letter from the bank saying, Thank you for your letter requesting specific information on you accounts with us. I can confirm that copies of duplicate statements have been ordered and will be sent under seperate cover. If you have not recieved these within the next 10 working days to contact them.

 

If you requested information relating to manual intervention on your account, i regret HBOS plc is under statutory obligation to record this information so therefor, i am unable to assist you further with your request.

 

Can anyone tell me is this a standard letter or have i made a complete errorr somewhere PLEASE HELP IS NEEDED.

Dont worry this is a standard letter.

Normally people get their statements a few days after recieving this.

 

So get your highlighters ready.....!:D

thanks for your speedy response , now once i recieve the statements do i just send out LBA or do i still have to wait untill the 40 days is up.

As soon as you get the statements and you have a figure, you need to do your spreadsheets and send the prelim letter first.

14 days later you send the lba.

 

You dont need to wait the 40 days, thats just how long halifax have, not you.

While you wait for the statements the best thing to do is read as much as you can so you can get an idea of what is in front of you. I read a lot of the threads when i started.

 

But dont worry, if you need any help just shout..! :D

hi everyone on 26th jan still not recieved statements but i have had the house upsidedown and i have found a load dating back to 2003 and we have totaleed up to that point and already is 2700 and that is without any interest and 3 years more to add, so it is really not to be sniffed at ,as we are off to Oz in June im sure if we win it will come in very handy.

Hi everyone just a little update, as it is now the 5/2/07, i decided to give the halifax a little phone call to chase up my s/ments, to my horror the girl told me there has been no request for them , i was fuming, i told her i had recieved an acknowledgement letter on the 17/01/07 and the s/ments would follow in 10 working days. So to cut a long story short she has re-ordered the s/ments today and says they will be with me in the next 7-10 days, i new this wasnt going to be straight forward for me coz nothing ever is, any way i wait in hope, there 40 days are up on the 20th feb so which ever comes 1st the s/ments or the deadline i will keep you posted.

Hi there just to let you know it is now 11/02/07 still no s/ments have chased with halifax have been requeated and she said it could take up to 6 weeks as they come from a different dept (i think NOT) there 40 days are up on the 20th feb so i will wait and then send my prelim ill keep you updated oh i am so frustrated.

Hi Giggles I received my statements yesterday, the 40 days would have ended on te 24th. By all means stick to your timetable, don't give them an inch, especially if you have a letter confirming receipt of your s.a.r .

Hi Guys Well i am pleased to tell you all that i have just got in from work and guess what 40 yes 40 envelopes on the floor oh what a fantastic thing to come home to after a really hard day, i have my highlighters on standby and will be reporting back later to let you all know the total. I cant wait i am so excited, havent checked any yet as my husband wants me to wait untill he comes in as he is just as excited as me. Speak soon

Hi Guys i am a bit dissapointed i requested s/ments for 2 accounts with the halifax they have only sent for one which the Grand total is £3,086 thought it would be more but hey this is good enough. What should i do now should i send my pre lim of with spreadsheet or wait untill i have recieved the other s/ments.

Advice very welcome
