Hi kevbevbabe,

Calm down. Take a deep breath. Breath out. Ahhhhhhhh.

Right on to business. Which letter/s have you sent?

Is the deadline up on you LBA?

If so you need to file a court claim, nothing to worry about and you can get all the support here. I have now cleared a few messages from my inbox so if you need to pm me then do.

Let me know exactly where your at and I will help you out.

If you are ready to file you can do it one of two ways:

1) Using an N1 form and dropping it in to your local county court, see here: http://www.consumeractiongroup.co.uk/forum/bank-templates-library/844-n1-claims-form-pdf.html for N1 with form filling or hear for a hard copy: http://www.consumeractiongroup.co.uk/forum/bank-templates-library/681-4-particulars-claim-n1.html

2) You may want to use MCOL (money claim online) see here: https://www.moneyclaim.gov.uk/csmco2/index.jsp

You will need to add a POC or particulars of claim however if you use MCOL there is limited space so you will need to use this: http://www.consumeractiongroup.co.uk/forum/bank-templates-library/34887-5-money-claim-line.html

Hope that helps for starters

im very unsure on how to word the LBA , as it states i will take them to a court claiming the full amount , but i can`t really as i still owe them £213 .sorry but its not making any sense to me!

hi all my husband had capital one card from2002 with £200 credit limit, unfortunetly went over limit and missed payments, so unbelievebly owed amount soared. I have gone through ststements and we have paided them ...wait for it.......£1462, for the 200 quid they lent us! they still say he owes £842.63, and as a goodwill guesture have agreed to remove £432, from bill. Can we claim all our money back, other than the original £200/ I,m confused, there time is now up and it,s time to go to court, but my husband doesn't want to lose anymore money and just wants to pay c1 to settle account. What should we do, i think they have taken enough money from us, we both work hard and have three children, that money could pay for a nice family break!

hello recieved a letter from cap one today , they say they are reducing my fees to £12 each and have reduced the amount by £72 , obviously this is not exceptable , what do i do next ?

Carry on with your claim, stick to the timescales you set and don't let them fob you off.

I have pm'd you.
