conradsfete, are claiming missold PPI, if so, see the template letters for reclaiming this, go to PPI thread i will find the link later. maybe you are also thinking your agreement is unenforceable? I cannot advise on this but you are certainly entitled to your data, you could send a reminder letter, also in templates re no response to data request.

could you tell me if they dont reply or i dont get my statements and the 40 days are up, do i stop paying them, send a letter ??? as bit confused. is it same as a cca request.

what rights do i have against them if my sar is past 40 days request?

i think if they are in breach of providing the agreement they cannot charge interest, or chase you in any way, but once it is provided and are no longer in breach you follow the agreement terms, I cannot pm you but if you pm me as only so much should appear on the open fourm, good luck,

Hi There - I did notice conradsfate has this at the bottom , like mine:

 

Interest calculated on the amount of credit and Acceptance Fee outstanding from time to time throughout the duration of this Agreement, taking into account the Payments above, makes up the Finance charges for the Goods and the charge for credit for the Insurances, which will be paid by you as part of each Payment.

 

Doesn't this mean that the Acceptance Fee has interest applied? Which would make it unenforceable?

 

I checked the amounts on mine, and they only make vague sense if interest is charged on the acceptance fee as well as the credit amount.

Hi - I've had 2 bog off letters from WF and now i'm ready to take court action for mis sold ppi as they told me taht i coyuldn't have the loan without it. Only thing is, i've looked through all the threads but i'm still confused about what to put for POC... any help would be gratefully recieved as i don't wnat to cock this up..

Hey Guys...

 

Just wanted to let you know that i have WON the claim with WF in court...( 7th of Feb..more than a year since the first complaint sent)

The Judge reopened the agreement on a based of Extortionate credit bargian and redused APR from initial 44.5% till 34.5%...

The judge also ordered to refund PPI and Medicare...and my costs...

Well, the judgement letter came through the post....i should have the refund by 28th:)) Loving it:))))))
