    • Just an update, finance company rejected my complaint saying they've found damage but can't tell when it's from even though I've shown them how the front end is misaligned in the advert photos compared to another identical model car they're selling.  Dealership now want to charge me to get the car brought back to me but will only discuss over the phone which seems off. They're also saying no damaged was picked up by JLR main dealership before I purchased it but my local JLR dealerships till this day haven't mentioned the damage to me because they don't go into stuff like that for some reason lol  Ombudsman case is still open, not sure if I should leave the car with them or just pay to have it brought back.
    • Hi all, I get esa and pip,  I have £1200 in arrears that I owed my ex partner, I have been paying £100 per month to clear this debt that was setup by standing order, as I have complex needs I forgot about this standing order and have overpaid mainternance by around £4000, I told CSA I am happy for my ex partner to keep overpayment I do not wish to seek anything back, however they have declined to take of the sum of £1200 and are still saying I owe this to my ex partner.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Ian (reidnet) would you consider creating a letter to the FSO that we could add our names and account numbers too... for us to try and see what we can do against welcome finance...

 

I think you have the most experience and would put together a great letter against these scumbags... maybe after letter from fso threatening them with revoke to their credit license will they listen to the many on here... The company is a joke and we need to use strength in numbers against them...

 

what do you think I am sure you would get lots of PM's with customers names and account numbers to begin the process... I feel this site can be used in a much more pro active way... while we all fight our own individual battles and get great support from this site, I feel we can do so much more to protect future customers of the likes of welcome. we all too easily bury our head in the sand and say shame but I hope it doesnt happen to me... you have been extremely helpful with so many cases and I apologise for putting this request to you but maybe when you get time !!!!

hi, everyone. sorry for jumping on thread but been reading with intrest.

i have a car that i had from welcome finance last year. i admit im 2 months in arrears. i pay £202.00 a month and i am strugling.

they have called at my house and put letters through my door and are phoning me a lot now. i answered and a very nasty woman started demanding payment over the phone rigt away. i explained i had not got that amount every month and wished id never taken the car. that i should have saved and brought a cheap one. she said i will soon default. i am at my wits en dont now what to do. i feel like im in a right mess with this one.

What you cannot do is bury your head in the sand and hope they will go away. They won't and you will end up with a ccj for your trouble.

 

In your post you did not mention anything about ppi. payment protection insurance. Did they apply it to the loan.

Maybe also start a thread on the General Debt forum as well for help and advice regarding the way forward with the debt. You can approach companies like National debtline, and payplan. they are free debt management companies that will help you.

good advice, you must not ignore it.

 

WF bully those who do not know their rights, start by looking at the templates library and print out the harrassment letter, add your own details obviously to suit your situation, basically they cannot keep ringing you at all times and the harrassment by creditors letter would be a good place to start.

thanks for reply, will take note and start new thread. yes ppi is on there but they did not tell me i could not claim if i had a pre medical condition. i suffer with my kidneys and touch wood they have not troubled me for a while. but when i asked at te welcome branch if i could cancel because of this he told me not to worry and not cancle as i would be able to claim.

Con, you can cancel it if you want. Have you got a copy of your medicare policy/PPI policy?

 

PPI will only cover you if you got fired from work...etc

Just a quick update: Submitted N265 -standard disclosure Received their copy as well....

 

Claim has been allocated to fast track...

 

Received an offer to settle: they close the account ( about £480 outstanding balance).... if i pay the cost of their defence £240...

Hi everyone how are you all doing yes its me and still alive just got an answer back from FSA the said i need to go to the fianancial leasing authority as they cant help so i'm thinking of going straight to court with these sharks any ideas?

hello mich7k, I have tried Finance and Leasing and had no joy with them, but others appear to have some positive feedback from them and even refunds, good luck.

I PERSONALLY HAD ONLY £44 REBATED TO MY ACCOUNT WITH FLA help.

I think I've kept an email address of Ms Charles somewhere. Let me know if you need it. Before you file a POC you have to make sure that it's well prepared and includes strong points. I haven't heard anybody won in court with Welcome.

I too have had a Welcome car loan similar to that of above, however I did not ever have a second page at all and the third page I have is not signed by Welcome or dated. In fact I still have the post it note stuckon from the broker just telling us where to sign. Apart from the fact, that I believe we were also missold the policy at the time, would this have been enforceable??????

I had a quick look on your agreement: it looks properly executed...I must admit, this is the best agreement i've ever seen from WF.

 

But you still need to claim your mis-sold PPI back...Have you got your statements yet? do we know how much of PPI has been paid?

I am about to try and claim my ppi back from wf. I have had a series of 4 loans with this company and each time I was told I wouldnt get the loan if I didnt take ppi. I was never given a policy to state what is covered by this insurance. At one point I was absent from work for eight months with depression after losing both my parents in the space of a few weeks, at this point I was told by welcome mental illness was not covered. I then tried to cancel the insurance and was told i couldnt.

They certainly made their money out of you did'nt they. Of all the companies that are discussed on this forum, I think welcome really take the biscuit. (That was a bit tame for me)

 

I am so sorry to hear your sad news and when you thought that there might be a chance for recompence with this ppi, to help you through this terrible time, it of course, let you down. Maybe better that you had broken your leg, which I am sure you would have preferred. It is a disgusting practice. If you are unfit to work, you are unfit to work. They put these exclusion in their t&c, because they have researched and found that these are the most common reasons for being unable to work. Mental illness and backache, these are included in the t &c.

 

If the ppi was made a condition for getting the loans, you have a very good case for reclaiming it back from them. Please read around the different threads and start one for yourself, so others can help, support and advise you.

redfan75, that is disgusting of Welcome Finance, but you are not alone, if you read around you will discover that many have been sold all kinds of insurance etc that they should not have been, however, they deny all. do not be put off by them, get all the infor they hold on you via a SAR, good luck:)
