    • Thanks I just had a quick look.  Will study over the w/e My friend does have kids. But it's a really dysfunctional family.  They don't talk.   Many years ago he sold 2 property assets and gave them a lot of money (enough to buy homes w/o loans) .  They've done nothing for him in the last 2 decades. And he altered his will so his new partner gets everything; the kids nothing (more). The 1st form I glanced at - to be deputy - asks for family details.   If I give his kids details I suspect the authorities may say they should get the deputy job instead?  Then  they will steal the money and give nothing to his partner. I can get a copy of the medical assessment  - and get it translated.  If need be.   This has all happened very quickly.  He got sick. And that must have kick-started dementia.   He was fine to hold a detailed conversation 6months ago; now he cant
    • Hi I think the only way around this as he lacks capacity is someone is going to have to apply to be a deputies via the Courts as he has assets here in the UK and a UK Bank Account which will take time and there will possible be Court Fees to make the application. Also if the Lack of Capacity (Dementia) was diagnosed abroad the person applying for deputies will need that diagnosis and it will need to be translated legally for the UK Courts so possibly cost for this as well. Also for reference although you were assisting them before the lack of capacity and had authority to act on there behalf that no longer stands due to there diagnosis of Dementia therefore Lack of Capacity so you no longer have any authority legally to act on there behalf unless the below is actioned or someone has Power of Attorney for that individual (which was setup before the Lack of Capacity) Have a wee look at these links: https://www.gov.uk/become-deputy https://www.lawsociety.org.uk/topics/private-client/mental-capacity-international-aspects#:~:text=You might need to make,act within the foreign jurisdiction https://www.gov.uk/government/organisations/office-of-the-public-guardian I have got to ask with the Dementia diagnoses are you 100% sure the diagnosis states they Lack Capacity as not everyone that gets a Dementia diagnoses may lack capacity initially. Now the Office of the Public Guardian link above you could also consider giving them a call just to give them a brief on this situation and get there advice on what documents etc are needed for deputies to be appointed as the person with Lack of Capacity is abroad.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Having spent a couple of weeks reading threads,guidance and generally experiencing others confidence, I've decided to fly the flag and go for it!

My personal situation is straightforward, I'm lucky enough to have minimum fuss and charges over the last 6 years, but my daughter (who's just setting out, gets married this year and doesn't like confrontation - has been a little bullied by the Halifax:-x ), has been continually charged as what seems to be a new year onslaught, as has my wife. We tried telephoning, but they won't see reason - so we emailed - stat reply "sorry you're not happy , we'll look into , give us four weeks", and we're still awaiting their comical reply! My Daughter has a parachute account, so she can build up her reserves from her wages - daft thing is that she can manage better than us, it's the charges that have created her mess!!

i also noticed whilst I'm at it, that some have managed to reclaim their penalty fees when switching mortgages - I've just switched mine (12 months ago), and had to pay after 15 years - £1970 for the privlege of paying it off! - so, i'm going for it ( I can can't I?):confused: .

and to add on.......forgot!

Wife asked for 3 X copy of original statements 21/12/06, was charged their £5 charge - chased Friday, told it wasn't enough time. She said that she wanted her money back - was told that wasn't possible, and should wait for her statements like everyone else does!!!!

had phone call today to apologise for delay for statements - offered refund for fees.

 

Letter recieved today in response to our "nice requests to refund charges over christmas" - told us to go away and manage our affairs better:mad: - perhaps arrange for DD's to be paid on Bank holidays!! -

 

The gloves are off ! - a nicely worded repsonse to the above indicating the matter is not closed, and the 8 weeks arre no longer valid as we are pursuing to the nth degree!:lol:

Question? - when it's time to do the LBA's after prelim letters do i take each as a separate item - i.e: wife; wife and me; me; daughter? - it seems to make sense whe arriving at a MCOL...?:confused:

I have 2 accounts with halifax, and i kept them seperate as it was easier for me to keep track. I didnt want things to get complicated at a later stage.

Update - bank phoned my daughter at work this morning, was polite, and said she was dealing with her complaint. (hasn't phoned us yet!);) - daughter said that she was busy and she wanted all dialogue in writing - this person agreed :-D .......can smell an "offer" she can refuse eh?8) -negotiations afoot methinks.

Getting fed up now!

Daughter recieves letter from Halilaffs - 1/4, yes 25% of approximate charges offered as a GOGW, usual c**p about being fair and transparent in their charging.....

guess what we're going to do?

Yes - correct in one - accept (but only if they offer the whole amount not yet claimed yet from the statements they've not yet sent, etc, that we can verify and add up, so's they don't under reimburse her):-D

 

Silly really, because this "helpful" lady applied another two charges to her account today.

Hi there i am in a similar position have not recieved my satements yet cant wait as the total must be around the 4K mark over the 6 years they are really making me wait for my s/ments, recieved acknowledgement letter after sar that was 8 days ago i am going to ring them to give then a polite reminder. but whatever help you need you are sure to find the answer here good luck kep us posted.

Had usual bog standard letter arrived today dated 06/02 from HBOS Thanking me for requesting specific info....confirming no statuatory obligation to record manual intervention....blah blah.........if not recieved statements within 10 working days, ring them, blah blah, love and kisses Kent Patton;)

 

now- when these arrive, the work begins...he.he...:smile:

had to chase Uncle Ken for the list of transactions - "we're a little behind" said a geordie lady - but you'll have them before your 40 days are up.....5th March!! :-o (claiming xtra days now when they get to their dept!!!!)

Recieved six years of statements for our three accounts - apporx 1700 to recover plus interest.:D

 

Funny how they sent just six years worth.....:rolleyes:

 

sending prelim off today - roll on the phone calls, or even a court case??

rec'd "sorry your not happy" letter today - interesting they quote OFT as giving 8 weeks to resolve, however they will try to resolve in 4 c*@p.

LBA due to leave here 12th March regardless - start the due process and onto another 14 days before MCOL.

FOR ALL THOSE PURISTS OUT THERE!

 

i wrote a cheque to cover a credit card bill - it hit my account a day early as a postal order which has taken five working days to clear my account didn't clear until today.

 

the margin in my overdraft was £2.95 after the cheque would be presented, so for less than 24 hours, i would be over my overdraft by £2.95.

 

cheque for £40 - hit my account yesterday morning - was returned to sender. Halilaffs applies penalty for £39.

 

I phone the hard nosed *@!!!'s and ask why?

 

nice man calmly tells me the cheque would bounce, even for £2.95 as they have an automated system - i'll have to pay another way! And, as a gesture of goodwill (he must have been reading from a script), he will cancel the charge as it did seem disproportionate (my word not his).

 

now i'll have to fight Crap one to take their charge off - Bummer!!!

update - if there's anyone out there!!!!

 

Daughter had an offer letter 8 days after posting all of our LBA's and prelims....

yep, it was a portion of what we asked for....so politely used the template library and accepted as part payment, but willing to go to court if necessary....blah blah.

Daughters account was closed without warning, so added that into the equation - man at Haliprats declared he wasn't personally responsible, but she should write in and complain if she though it was cloased inappropriately.....(thought we'd done that).

 

Intersting that our daughter had an offer from the prelim and we'd been ignored, and gone to LBA. A theory could be - she's more likely to borrow on mortgage terms thanh us, so show her willing first? We moved our mortgage from these people as we had too much "in house" there. Wife left Haliprats after 10 years, over six years ago. High pressure selling.

Phoned nice lady at Halifax - really professional but didn't want to offer the interest accrued as part of the original LBA and said "we will consider only the amount without interest" - "we can't pay interest" - then offered £7 more than my amount claimed without the accrued interest because of the charges!!

 

wierd.......

 

so i said apologetically (because she was sooo nice), "I'm filing a MCOL this evening, if you want to up the offer, then you have until 6pm"

 

 

then PMSL:D :D :D (just have to wait a little longer for the dosh + interest+costs + 8% - a little xtra - just intime for my daughters wedding I hope)

Im just checking, did she offer you the full amount of your claim including an extra £7?

But you turned it down because she wouldnt add the interest.

Didn't turn it down - accepted as part payment.

 

Argued that some of the penalties applied incurred interest (as per the schedule), this was the basis of asking for the full amount - and didn't add in the 8% -until I may go to court.

 

Penalties charged + interest accrued BECAUSE of the penalties applied = claimed amount ?

 

Have I got it wrong?

If they are paying you the full amount you asked for, then i cant see what the problem is.

 

I understand what you are saying, but if you go to court and they see that haliprats have offered the full amount, i wouldnt think they would see the point of you fighting for more.

 

You can always double check with a mod, as obviously they know more than the rest of us.

 

You can normally get some of them in the chat room...
