Hello to everyone from the lovely South! I have had enough of those vampires in business suits bleeding me dry,so it's time to strike back!! :mad:

 

I have already received the small claims pack and have read a little bit in the variuos threads,however after being charged twice in the past week for £60,bringing the total to over £1600,i have had it!!

 

I bank with Barclays and think their Service is appaling anyway,so i guess after this is done i will maybe go to the co-op? Anybody know if they are any good?

 

Anyway i will now carefully read myself through the relevant threads and then kick some Barclays-ass....:D

 

for any hints or tips i would be very thankful and all the best to everyone with their respective claims!

Hi Everyman, welcome to CAG.. I am glad to see that you have started off on the right foot by getting the pack etc and doing a lot of reading.

 

Once you start your claim you can post a thread in the Barclays forum, where members their will guide and help you with all the info on Barclays.

Well, if Barclays are anything like Barclaycard, they might well make you go all the way to court. Don't worry, however, you'll get good advice and help here and your experience can help others later. The law is on your side, just settle down and see it through. Don't forget to charge interest (compound), court fees, personal expenses and anything else that other people on the site may recommend. The bank may have cost you more than you think when you add it up.

Hi Everyone,sent prelim letter to Barclays,got a reply a la 'will get back to you next decade':rolleyes: ,14 days now over,will send LBA today.... rang compl. dep. twice and apparantly both times their systems were down..... yeah,right... see u in court,sucker!!! :D

got a letter from Barclays offering me 870 quid out of my 1560 P. owed.....:lol:

 

will send rejection letter today and in 2 weeks file the court case! Cheeky bastards they are....

Hi,

 

just received a'general form of judgement or order'. Sauer v.Barclays

 

Before District Judge Fawcett sitting at Brighton County Court

Upon the Courts own motion.The court has made this order of its own initiative without a hearing.If you object to the order,you must make an application to have it set aside,varied or stayed within 7 days of receiving it.

 

IT IS ORDERED THAT

 

All claims for repayment of bank charges are stayed until such time as the High Court has determined the application by the Office of Fair Trading for a declaration that such charges are unlawful.

 

So,what do I do now?

 

How do i apply to set aside? I am a drama student and work only part time? Surely i coulsd argue hardship??

thats the spirit! In any case whats the worst that can happen? OFT lose case you lose court fees about 200 pounds..but this aint gonna happen! OFT for sure will win, banks are already talking about appeals etc..does not sound like a positive attitude to me!

I don't give up easily!!

 

thing is,if the banks believed they were right,they would've taken the first claimant to court(meaning they would have actually shown up!!!!) and fought the case all the way through!!!! Even if it had cost them a million pounds,if they had won,no more claims,EVER!!!!! But they didn't,so they know what they doing ain't exactly legit! they can afford all the solicitors in the world,so.......

 

also i believe the OFTwill be successful because this has half the nation up in arms by now,a decision has to be made,one way or the other!

I'm hoping that a lot more bank staff are going to come forward and whistleblow, hopefully even leak more internal documents to the press!

of course it's not 30 odd pounds! I find that amount offensive!! it's a lot of money,especially charging multiple times!

 

market-driven economy is ok but i believe in the UK it has turned into a rip-off attitude from hell!!

OK guys, I really need help on this one.

 

as you may well can see from this thread Brighton County Court has slapped a general stay on all bank charges cases pending the outcome of the OFT test case.

I applied for a lift to the circuit judge,and lo and behold,a hearing will be held soon(a clerk at the courthouse told me from looking into her comp.system)

 

So,what do i do???? Anybody been to such a hearing yet?What do i have to do?How do i present my case?How do i argue?pls. pls. help as this is my BIG chance to sway the judge and have my case heard and not wait 2 years...

 

PLEASE HELP!!!!!:) :) :)

Is the hearing to lift the stay or to hear the charges claim ?

Any typos spelling mistakes are due to leprechauns in my keyboard they move the letters around sometimes (amended just for Bookie)
