There was a posting by Bankfodder in January 2007, that institutions knowingly and therefore criminally levied unlawful charges, thereby putting themselves beyond the protection of the 6 years statute of civil limitations. There is no limit on retrospective criminal prosecution.


However I am not sure if institutions are legally obliged to supply you with back statements beyond 6 years past. If you supply an estimate of total unlawful charges levied before 1999, being a large part of or the whole balance of what you allegedly owe, and if you say that part being legally unenforceable being contrary to law from the beginning, then you put the onus on the creditor to prove the balance owing is legally valid.


Best to SEARCH, ADVANCED SEARCH, "limitation" or "limitation", and read up the subject. I am not sure many have gone down this difficult path. If you were the first one, then Bankfodder will probably take an interest, maybe help, but you need to prove you are serious.
