I have supplied Lloyds's solicitors and the courts with documents that were requested, in preparation for the hearing on 30th January. The 14 day deadline ends on the 16th and I've still not recieved anything from them. Taking into account that there is a weekend between now and then it isnt alot of time.

 

What happens if I do not receive copies of the docs they'll be using at the hearing?

Then you write to the judge asking for their evidence to be struck out for not complying with the court order. See my thread (andy ross v lloyds) I didn't get any papersd, when I called SCM they told me they hadn't had any instructions. You won't get any, they aren't going to supply them.

I have written to the court with regards this.

 

We recieved a reply saying that the defendant must comply with the court order before the hearing on the 30th.

 

They havent complied. We havent recieved any docs from them, should we still attend court tomorrow? If we do is it likely that SCM will attend?

You must still attend tomorrow, it is unlikely SCM will turn up.

 

However, keep checking your bank account right up to the last moment. Until such time as you are aware that you have the sum in your account, you must still attend. They really do leave payment until the last moment sometimes.

Sounds like you have a pretty good case against them. Yes you should attend still and more than likely SCM won't then thats another case won.
