Thanks for the input summanotre. Although as i understand it you can't go bankrupt and keep it hidden from other parties in the household as doesn't a receiver visit to access your possessions etc?

No, thats not true. Nobody came to visit me. If the debt is yours and yours alone, even if someone else lives with you - it has nothing to do with them.

 

All I had to do was pay the fee (Oh sorry forgot to mention that :|. I dont know how much it is now but when I filed it was £200 which my mum gave me - although I believe that can be reduced or waived depending upon circumstances although Im not 100% sure about that one), then you fill out a financials form and visit the court to see the official receiver and you will get the results through the post.

 

I've noticed sunray001 has pm'd you, so perhaps you will get better advice from them.

I think the fee is £500 now (inflation!) but still an option possibly. I'm going to look into it as im up against a brick wall and even though the Law (CCA1974) is on my side, when financial institutions refuse to acknowledge that fact it's very difficult to move forward without taking Court Action and that would only clear £12k out of £28k. (The rest being properly executed.)

 

At least the creditors wouldn't get anything and that's something i could certainly live with :)

If you go down that road (and its really not that bad) make sure you check out The Insolvency Service Website as it will have all the updated information and if it doesnt state anything about whether the fee can be waived, then send them a message and ask.

Thats what happened in the case I was talking about.

I am trying to write a book on being in debt.

 

I would appreciate any short comments and peoples experiences in their own words on how debt has effected their health and lives. In particular the stress it causes and what being ignored by Lenders and DCAs when you are trying be responsible has felt like.

 

Only short comments wanted please. Say about 300 word max. No massive letters and i am more interested in the psychological effects and mental state, the frustration and stress that attempts to communicate with creditors has brought, rather than the legal side or section 78 failures etc.

 

I would prefer comments sent via hotmail or yahoo (link on the left of these posts) and not posted on the open forum please and rest assured your name/username will never be quoted. All in strict confidence and for my own use in writing about the subject matter and any information will be changed as to keep any comments i may add to the book as anonymous and not traceable back to any individual in any way.

 

Thanks folks... something may come of it. I may be a rubbish author! If it's not good enough for publication and if i ever finish it i'll post it online for download to try to help those being hounded by the evil doers.

Debt collector complaints on rise ? so what to do if they come calling - Scotsman.com Business

 

"In most cases, according to the FOS, inquiries are followed by a call to the company involved from the ombudsman, and issues are quickly resolved."

In other words, the FOS call up the DCA and they say "we've done nufin gov" and the FOS say "ok thanks for clearing that up then."

First contact i have had from Link Financial (who bought the MBNA accounts) today in the form of a statement. No interest has been applied since being defaulted and no request for payment. Just a statement of account/s.

 

Last communication from them was an invalid default notice (the second one placed on those accounts) last september 2008.

 

No reply will be sent. I'll see if anything else turns up one day.

Davey> In your circumstances why would you bother to pay them a penny, worse they can do is defaults on your credit files, maybe one or more CCJ's but after 6 years they will all be cleared, maybe after 3yrs if this new bill goes through later this year with a change in the Limitations act 1980 from 6yrs to 3 yrs! The more you keep contact with the lenders the 6yr period keeps starting again! They certainly wouldn't waste their time with the big B nor should you make yourself Bankrupt! (its costs a lot of money!

 

After a few years they will all go away and the debts won't be chased due to your circumstances, let some other mug pay them, they are all ev$l best$rds anyway.Once they get a sniff you are paying them they will hound you relentlessly, my advise IGNORE THE LOT Best of luck!

Yes i noticed that this morning. When the banks, judges, government and financial institutions are all in cahoots with each other, went to the same private schools together and lunch together at the golf club every Sunday then you can't expect fairness or impartiality.
