      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

Just a question - I paid my mum's capital one balance off for herlast Friday (5.01.2007) and capital one reckon that it takes 5 working days for the payment to clear.

 

Does this mean that they will have charged interest on the balance for these 5 days, and is that correct?

 

I was under the impression that debit card transactions cleared at the person you were paying straight away?

Watch this one - I paid off 5 cards in full on the same day in mid November last year.

In each case I made a debit card payment over the phone directly to the card company in question.

In each case I asked the card company to calculate the total amount owing including ALL interest up to the date of payment.

In 4 out of 5 cases I then received a statement a couple of weeks later with, you have guessed it, additional interest for the 3 to 5 days while my payment was being "cleared".

 

Each of these cards was on a direct debit and fortunately I had cancelled each of the DD's when the cards were paid off as each company tried to collect the "extra interest" by direct debit.

 

In each case I contacted the card company, told them I had made full and final settlement and that I was not going to pay interest on a zero balance and that I had been told the amount I was paying was full and final.

 

In each case, over the phone, they refunded the "extra interest" without question.

 

 

The only problem was barclays premier who took 8 phone calls and 3 letters to finally get the interest off the account - at no stage did they say they wouldnt clear the extra amount, it just took an awful lot of frustrating calls to find somebody who could actually punch the correct buttons on the computer.

Missed off what I wanted to say!

 

I think if C1 do try and charge you, then go back to them and tell them that you paid the card off in full and that you had confirmed the amount of the payment covered the balance and any outstanding interest prior to payment.

Be firm with them and I am 99.9 pct certain they will clear the card to zero for you - they were one of my 5 cards and were fine when I spoke to them.

Well, I actually paid this off for mum and they were so unhelpful - I asked them to just pay it in full nad not even tell me. She wouldn't so I gave her a figure of £700.00 - my mum tells me she only had a balance of around 650 and her limit is 500 or 600 so they have actually been in credit for the last 5 days.

 

I will see what happens when we can access the account - it's scandalous. Pay anythign else by debit card and they accept the payment immediately

I just told them what had happened eg - wanted to settle the account, they gave me a settlement figure, I paid that amount to take the balance to zero then they charged me interest. Told them it was their mistake and I was not going to pay and they should check their phone records before they try and recover the money (it was only about a tenner!). They put o me on hold for a bit and then said they would wipe off the interest (although they never admitted it was an error).
