    • who is it from  a council or a private parking company?
    • As per the heading, received a parking charge for failure to display a blue badge in a disabled bay on a retail park.  I am a blue badge holder, disabled/wheelchair user with a Motability vehicle. I received the charge as 'notice to keeper' I was not the driver. I don't have a valid driving license so use a carer. The notice arrived a week after the alleged incident. It states that as the 'driver' failed to pay the charge in full  hence, it is now the keepers responsibility ( the notice was dated 2 days after the alleged infringement and as no notice to driver was on the vehicle, I don't know how they expect the driver to be able to either pay or dispute the charge if they are not aware of it) Anyway, really looking for help how to reply. I cannot remember if the badge was correctly displayed or not. Photos taken of car miss a bit where I store my badge if not displayed so it would be possible to see a badge even if not 'correctly displayed" . It was a bit of a sh**ty day weather wise, gusty and raining  (as seen on the photos which reminded me of the actual day) so it is possible that badge blew to the floor as the driver was helping me out of the car into wheelchair. There is no windscreen photo showing that a PCN to "Driver" was stuck on the window either. The car park is free. There are no Parking Signs at all near the disabled bays that one could read to adhere to any terms and conditions. The whole row of disabled bays - of which are there many only state badge holders ( does not stipulate Blue Badge Holders) The notice states that the parking company is a member of the BPA and Operating in accordance with the British Parking Association's Code of Practice. The BPA, section 19.1 State that at least one parking sign should be near the disabled bays, in a position that can be easily  read by by a disabled person without leaving their car in order to decide to be bound by such terms. We returned to look for signage on the retail park and could not find one sign that was near the bays. The only sign we could find was high up on a pole but not near the bays. Someone had to get out of the car and stand on tip toes to be able to take a photo of a sign. I would be grateful if someone could help or point me in the right direction. It is now  15 days since the alleged incident and 7 days since I received the notice.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys

 

Iv sent my letter to Halifax with a copy of my statements worth over £2000. They have sent me a letter back and saying they have received my complaint and will get back to me within 4 weeks.

Do i wait until the 14 days are up still before i send the LBA.

Also at what part do I send them my Spreadsheet (havent done this yet).

Im really scared about this as im about 500 pounds over my overdraft limit at the moment and am really struggling financially.

I need someone to hold my hand and basically be patient with me. Im really sorry if im asking the same quesitons, but everyones case is slightly different to mine. Sorry again

Hi there. Dont worry we all start out a bit anxious. Make sure you read ALL the FAQ's and read quite a few of the threads just to get your head around things. In responce to your LBA yes, send it after their 14days are up, make sure you stick to your time scales NOT theirs (they would be quite happy to make you wait 4weeks for every letter). I will keep an eye on your thread so if you need help just post it here and someone will be able to answer your questions. Hope all this helps and if it does tip my scales. Sarah

Its just so complicated as this jargon makes it hard to understand. I want to know what i am sending them is correct and that everything that i am sending them everything.

Its so nerve racking. If this goes to court is there anyway i could get myself a buddy, im in Woking Surrey.

If you go back to the main page of this site there is a buddy system that is already up and running. Just enter your post code to see if there is anyone near you.

The only reason that you are so nervous is because this is all new to you at the moment. When i first started i got a bit wobbly and now im doing loads of things at once and its not a problem. As soon as you get used to the way it works you will be fine. As long as you read other threads and FAQ's you will not get anything wrong.

Just want to ask when are you sending your LBA off? Just remember to check the date on your paperwork, sign it and include another copy of your list of charges.

Hiya

 

Iv sent them my request for repayment on the 04th Jan so they have 14 days, (even though they said they would get back to me in 4 weeks) so i will send my LBA off on 18th Jan, Is this correct? Do i send the spreadsheet of interest with this letter?

Hi, No you dont include interest until the court stage. just the standard spread sheets at the moment.

Im sorry im really confused i thought the standard spreadsheet was the interest spreadsheet.

What spreadsheets do i need to include. I havent done any as of yet.

 

All iv got is the SAR letter and the Request for payment letter with my statements.

Right well im just getting everything ready, got to send the LBA off tomorrow. So i just use the letter template 3. LBA, what else do i do, is there any spreadsheets i need to complete? When do i need to fill out the MCOL? Im confused because iv been reading the threads and everyones been doing different things to me.

I went onto that website 'Vampiress' and registered, but the spreadsheet says 'View Only' arent we able to download this into Excel or do we complete it on line and print from there?

Hiya Bex,

 

First of all dont worry about mcol just yet.

 

Right, use simple sheet, 1 is prob best.

 

When it says veiw only press file, then press copy spread sheets,

a small box will appear, press ok.

 

Fill in your own details, normally charges as notified, date, amount.

The interest will fill itself.

Ok thank you, it says theres no need to include interest until it goes to court, so shall i just hide the column with the interest in and then use it when it goes to court?

 

Also, iv had more charges since then so what do i write in the letter? something like this:

 

Since my last letter dated 04th January 2007, I have incurred more charges, please find attached the schedule of these charges. Therefore the total i wish to claim back is now £xxxx.xx'

No you dont need to write a letter, just add them on to the schedule, you can do this up until the court stage.

And yes just hide the interest column until the court stage.

HI Guys

 

I am just preparing my LBA, just a quick question? Halifax sent me a letter saying that they have acknowledge my letter and will get back to me in the next 4 weeks so what do i put in the letter as the LBA letter currently says the following:

I am very disappointed that you have failed to respond to my letter of the [XXDATEXX].

Because they have responded, i just dont know how to word it.

As they have responded but you are not happy with the responce. Thats what i have done. Seems to me you are starting to get your head round this now.

Yeah just about, but still dont fully understand all the legislation around it, which is what im worried about if it goes to court.

I cant believe they have charged me an extra £369 in charges since 26th Dec, im adding that on to my spreadsheet

Nope, nothing else to send, just sit and wait your 14 days for a reply, if no reply, then start the MCOL.

 

If you are not sure about the MCOL then maybe start reading the information now, and even start writing a draft ready, then any questions you have can get answered here before your 14 days are up.

Hi Guys

 

Iv sent off my LBA, just waiting for a reply.

 

Im not sure about anyone else but im getting the feeling that Halifax seem to be defending and going to court more then before.

Im really really worried about going to court, im happy to go because i believe i should get it all back. but im not good talking to people i dont know and especially about things im not 100% clear on. How can i prove what they are doing is wrong? Im getting myself in a bit of state about it. iv been reading the quidance notes etc, but im just getting myself in a pickle. I just dont want to go to court and end up looking a fool by suddenly going blank and not know what to say. Iv been looking at all the threads but still having problems understanding how i can get a proper case together if i have no evidence that it doesnt cost the banks that much. Im just really scared

Where have you read that Halifax are taking people to court now?

 

I'm in the same position as you in that i sent off my LBA on Friday and i'm awaiting their response. They didn't even reply to my first letter. But apart from snippets of what i've heard on TV etc, i don't really have enough in depth knowledge on why i'm owed this money back to actually take it to court.

 

I was confident about my chances but after hearing what you've just said, i'm now really worried!!! I can't really afford to make a claim and pay the fees, only to lose.....

 

Can somone advise?

Well iv just seen a few of the threads and some of the ones i have read, they have actually gone to court. So seems Halifax are getting tougher.

 

Sorry dont mean to worry you, but thats exactly how i feel. I cant afford to lose. I felt confident that they would pay up before it got to court but now not too sure. Im just panicing now.

If it goes to court then im going to be on this forum 24/7 trying to get my head round this to make sure iv got a good case. I will probably still make an idiot out of myself

Hiya Bex,

i think most people are following Wilkins vs Halifax thread, as this is the closest i have heard to getting to court.

But i was told by the lady at my local court house that if they take it to court then they will open a floodgate as if the accept they are wrong then all hell will break lose.

The way it is now, they are paying out but not accepting responsibilty..(fine by me as long as i get my money).

I wouldnt get too worked up yet. :)
