Just read the Defence they say one of my charges (£20) is out of date and I cannot claim for that but it was calculated from the first letter I sent to Barlcays. It is out of date now but I started the action in August 2006 when it was not out of date and did the calculations as I should have. My AQ is now with the Court will it be thrown out by the Judge becuase one charge is out of date what should I do as too late to get the AQ back as I am out of time

Proceed as normal Conni, it is highly unlikely it will be thrown out because Barclays claim that one charge is out of date. Read up on the limitations act/claims over 6 yrs for more info. The worst that can happen is that they will settle less the £20.
