I have just realised that on my claim i have calculated interest at 8% each year on each charge, I used a spreadsheet so i know that this is correct BUT I went on to say that daily interest will be charged at 8%. By this I mean from the date the claim was submitted to the date it is settled.

 

Obviously this is the rate per year NOT the daily rate? I have received a court date for 19th of Feb and I am in the procee of putting my bundle together? What on earth should I do!?????

missmoneypenny I presume you mean you haven't broken it down into a daily pence figure? I wouldn't worry about it too much, it's not a fatal error and can be clarified at a later stage if need be. The daily rate shouldn't amount to much anyway, unless you have a whopping claim, and more than likely the bank will forget to pay you that figure upon settlement anyway. At that point you can work out the daily accrued interest and advise them of the current outstanding total of your claim for settlement purposes. As for the bundle, continue as normal and submit all the relevant papers as necessary...if you wish to, you can clarify the interest part in an added sheet.

What was the exact wording you used for the interest part?

"The claimant claims the repayment of unlawful bank charges for the period August 2004 to october 2005 amounting to £349 for exceeded limit and late payment charges.

The claimant also claims interest on this amount under section 69 of the County Courts Act 1984 at the rate of 8% a year from August 204 to October 2005 of £63.67 and also interest at the same rate up to the date of judgement or earlier paymetn at a daily rate of 8%"

OK, I suggest the following:

 

Please be advised that the interest claimed at a daily rate of 8% equates to xxx pence per day up to the date of judgement or earlier payment.

 

Keep it simple, add the sheet behind your copy of the Claim form (Particulars of Claim)

It is advised that you put all the documents relating to the claim in there, and yes I would put both of those in. Since you didn't take a copy of the AQ, you'll obviously have to leave it out, but everything else needs to go in there, including original statements etc if possible.

 

Check the templates library for the information on suggested court bundle docs.

No prob, just go through it carefully - it's quite self-explanatory. Do bear in mind that it is just a basic court bundle...you should add in whatever you feel relates to and can strengthen your case. I'd read around the subject first...there is plenty of info available on this site. Anytime you need further help, just post on here :)
