    • Hi,   I sent the email to both my local councillor and the leader of my local council yesterday evening. I didn't receive an acknowledgement email. Do you know if I should have, as I know that if you ever email an MP you always receive a acknowledgement email?   Walshy

And to strengthen your case take a look  look at a thread by Tom Price also at Southend airport which is several threads below yours and you will see that he won his case on the fact that he was stopped rather than parked. On top of that he had the Airports Act  1986 to quote. The relevant section is no 63 " Byelaws are covered at S.63  (2)Any such byelaws may, in particular, include byelaws— (d)for regulating vehicular traffic anywhere within the airport, except on roads within the airport to which the road traffic enactments apply, and in particular (with that exception) for imposing speed limits on vehicles within the airport and for restricting or regulating the parking of vehicles or their use for any purpose or in any manner specified in the byelaws;" That confirms that the roads at the airport are either covered by the Road Traffic Act or Byelaws neither of which is relevant land therefore  PoFA cannot apply. And  VCS should be aware of that. Another thing is that when you posted their WS you didn't include their contract which I missed at the time. However Tom Price included it in his. And guess what-the  alleged offence they are pursuing you for, No Stopping, is not included in their contract. If you look at the end of their Service Agreement [aka contract] you will a list of contravention on Scedule 1 [7] (46) PARKING/WAITING ON A ROADWAY WHERE STOPPING IS PROHIBITTED That is the nearest to what you did. But you were not parking nor waiting -you were stopped so there was no reason to issue you with a PCN as you never broke any of their contraventions. Looks like they breached your GDPR and you should include that as it carries a hefty charge £750 is not unheard of.   Have a read of his WS too which may give you further ideas even possibly to rebut some of the points VCS  make.

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

Just to say I sent my letter requesting Statements on 28th April.

 

So we will have to see what happens, but I have got the ball rolling as they say.

 

I only stumbled across this site last week, it's worth a go to try and get MY money back.

 

I may need some advice, but I know you lot will help me :D

I am sorry if this has been asked before, but wasn't sure if I found the answer in the FAQ's.

 

Can I claim the overdrawn charges that they put in place, every month, they charge me £25 a month.

From the sounds of it the £25 is because you are over your overdraft limit? If that is the case then yes you can.

 

If the £25 is a fee for providing with you with an authorised overdraft (I doubt from the amount it is) then no you can't.

 

If this doesn't make sense, SHOUT!

Yes, you can claim the charges for exceeding your overdraft, but not where it's a charge for arranging the overdraft.

I sent my letter off nearly 14 days ago (this Friday) to get them to send me my statements, but nothing has come back yet.

 

What is the next step, or am I being to eager with the 1st letter.

A bit lke I ws too eager. If you sent the DPA request you should wait the full 40 days that they have to reply within. You could phone up the customer services line and ask to be put through to the DPA department and ask them what's happening to your DPA request. For phoning the bank line you could use the non 08457 number - 01226261010 - might save you some money - depending on the type of phone service you have.

I got home last night and had a letter from HSBC saying they received my letter and will be sending my statements to me soon.

They also gave me the cheque back as well.

 

So we will see what they owe me once the statements come.

I didn't get my statements back in one lot, they came in about 10,000 envelopes (or so it appeared!) so you might find they will come in over several days.

They have not supplied the correct information within the 40 days?

You can get your statements online via the online banking facility so I am told, the important thing is that you have requested any details of manual intervention on charges, so if you get to court there are no nasty suprises.

Add up your charges and send off your first letter.

Some folks have made an estimate of the charges, the bank cannot disagree because they did not supply the correct information to start with which they are legally bound to do. If you were to do this, I would check with the bank, they might have been lost in the post.

OK Mark, you need to start proceedings against them for non-compliance to a valid request.

 

SEE HERE - and use Template 2

 

This gives 7 days for a full disclosure, otherwise start legal action.

 

If we reach that point, let us know.

just out of curiosity, cant you use the internet service to check your statements, it will save you a lot of hassle , and indeed time

Possibly maverick, but we also need to force these banks to comply with valid DPA requests.

I found that too.

last year I could access statements going back years.

Now it only goes back a month or two. Perhaps something to do with the fact I have filed a claim against them?

jonni2bad (like the new avitar by the way) is right though, these banks need to obey the law and give the information they should, it's only printed out from the database anyhow.

Doesn't work on mine, like its been disabled.

"There earliest you can view is may" (or similar) comes up at the bottom.
