      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No I dont think they'll give up as people will often still either give up or settle at the first offer, so saving them money. They wont just give in until they are told legally they have to.

All & Pester have already been ordered to pay compensation for this. You need to make a complaint to All & Pester follow it through until you get a letter stating "final decision", then register your complaint with FOS who are not impressed with them to say the least .................. He who laughs last and all that .................

Well I might just do that.

Hi i'm new to all this and amazed you got all your money back....well done!! Heard that they're one of the worst for digging in their heels. I'm claiming for £6831 excl interest but going to claim for that when time comes too. I've received a letter from them in reply to my request for repayment but got a big no danger from them!! Going to pursue but my problem comes taking it to court. As I live in Scotland I can only claim for £750 at a time and a lot of the courts now won't accept multiple claims. Been advised to go to FOS. If anyone else has had to go down this road would appreciate wee bit help. Too much money not to claim!!

hi ya its maddie, can any one help me. can i claim my monthly over draft fee, and interest in some months i was only charged £5 AND £1.42 interest. some months over draft fee £25.00 and £2.16p interest. thanks

no you cant claim normally claim the monthly overdraft fee or the overdraft interest - they are authorised charges by the bank for you having use of an overdraft.

You can claim returned direct debit/cheques etc.

 

suggest you start your own thread. Non-one will find you attached to mine.

Go to the bank charges front page, scroll down to whichever bank you're claiming against, click on it and start new thread.

you can claim unauthorised overdraft fees of 25.00.

But not the regular authorised fee of 5.00.

And not the interest unless the interest is charged as a result of being charged an unlawful fee.

So what would happen if you haven't got an overdraft facility or only arranged one mid way through the re-claiming charges period of 6 years say and try to reclaim all the monthly OD charges? Anyone any experience of this? I've read of someone who was successful in re-claiming these charges, but I've no idea if they had an arranged OD facility or not.

depends on how much the claim is. I had to pay £120 for mine (over £3000) but its less for smaller claims.

I am just about to file with the courts and the fee has come up as £120.00, do you have to pay this amount straight away? And did you get it back from A&L?

Also on reading your thread I notice that you can't claim monthly OD chgs, I have included this in my orginal letters to A&L, can I take them out now? Sorry another question can I claim unauthorised OD Chgs?

I've kept mine in ... seems to be debatable if you can claim some of these monthly OD amounts or not. As far as I'm concerned, A&L have never pointed out that these cannot be claimed, only that NOTHING can be claimed!

1. You have to pay fees up front - you will get them bck from A & L when you win - they should pay these with final amount.

 

2. Monthly overdraft charge - I understand from reseaching the site that the standard fees(shown as monthly OD charge) are not reclaimable. If you have an agreed overdraft you are actually borrowing money from the bank and they are entitled to charge you interest on it.

You can claim for unauthorised overdraft fees, returned debit and Standing Orders etc

Hi everyone.

 

Im reclaiming my charges from A & L for just short of £1000. Ive got to the stage where Ive sent the letter saying that Ill take them to court.

 

When you say that you give them 7 days to reply, does this include weekends or just business days?....

 

Wish me luck!!! Ill let you all know of the outcome

Hi,I am going to court on the 12/07/07 against A & L for £1,200, they sent me a cheque for £347.00 for which i sent back , only 2 days left getting a bit worried about Thursday This is in Scotland and i have sent all the template letters from Martin's site this is been ongoing since Feb 07 has anybody been to court ? or do you think i will get a surprise in the post on Tues, or Wed, can anywon give me some advice please.
