      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok, so as of now I haven't received my offer letter or any acknowledgement that one is being sent, so I have sent (and cc'd Dino) Paul an email saying that if I haven't received confirmation that it is in the post, or can be faxed through today, then I am going to have to book the day off for the 29th. after checking the letter from the court, I can't see that I can even say I'll take a half day, as it could be delayed anyway!

 

I'll give hime til just before 5, then i will book the day off, and readjust my claim sheets accordingly, sending a copy of the revised claim through to Paul.

The date took about 3 weeks to come through...

...but each court is different on time, approach and method!

 

Fingers crossed there is something in the post, as I am getting a bit pee'd now - I was hoping this would be settled by today...some hope!

fingers crossed peter,do you have to wait for court date before contacting them getting twitchy now, ready for fight, sorry i mean negotiation.in the mood now had to ring them about problem on buisness account, 0845 number, after about 10 mins she said could i ring back monday i said can you give me a free number to ring,she said no it had to be this number ,i said i should not have to ring a number you are making money from for complaining about incompitance on your part,she said sorry but thats it.so they must welcome complaints to make more money out of us.by god this is good therapy , ta.

signed the petition and thank you!

 

received reply from barclays offered £500 out of £629.03. Don't know what to do.

 

So replied to them and requested to add charges of £240 charged from January '07 to April '07 with the offer of £500 over all total of £740.00. They are declining the £240.00. Please help.

Hi davaom,

 

Take the money and run, or sit tight, follow the 'rules' as they are on here and take court action at the appropriate time.

 

You can add the extra £240 so long as you haven't filed at court yet, so that's not a prob. Barclays won't increase their offer, they don't do that, but will pay out in the end!

 

It's your choice!

No, still no contact what-so-ever!

 

Frankly, I'm bored of it now - I am going away for a long weekend, from tomorrow lucnh time, and won't be back home til Wed afternoon. In my opinion, this doesn't leave Barclays enough time to send a letter, me to sign, and them to pay in, before next Friday. therefore, unless I here positiovely from them before the end of today, I am not agreeing to anything before the court date.

 

No more I can takes, and I can't takes no more!

can anyone help - I want to use the copy of the email Dino sent me as evidence that they are wasting court time, and have no intention of actually defending, do i need to send this to the judge before the court date, or should I just take it with me as evidence?

 

I know sometimes you can only rely on evidence the court has seen first - but my letter from the court didn't state that?

 

Or should I do both?
