If that was the reply to your letter before action, then it's time to start the action that you stated in it. Check out the step by step instructions. It's all there for you.

Hey Caro,

Thankyou,

Yes indeed it was the response to my LBA. They are saying that they are still looking into my complaint etc, however I am not waiting around for them.

Its time to get serious!!

Het Caro,

Just had a look at the step by step, and I think I know what I am doing.

HOWEVER - not 100%

What are the basic things to do next?

Is it the moneyclaim part etc?

Also not 100% on the spread sheet to use and in fact how to use it.

Cheers

Rich

Yes this is where you need to start paying out a bit but you will get that money back when you win your case. I believe that MCOL is quite user friendly and they have a good help system. All the details you will need are on this site providing you look for them. Just make sure that you know exactly what you need to be doing and read up on everything. If you need anymore advice just shout :D

Hi there!

Just thought I would give you links to court information and choices. You may not have to pay the money if you are exempt from fees, so it is worth clicking the link below.

INFORMATION ON FILING IN COURT

Fees

You can apply for an exemption through the court when you file your claim so it is worth a read and if in hardship, worth applying.

http://www.hmcourts-service.gov.uk/H...fl ets_id=172

Money claim online - OFFERS NO FEE EXEMPTION

5. Money Claim On-Line (MCOL) Particulars of Claim

http://www.consumeractiongroup.co.uk/forum/site-questions-suggestions/71369-getting-mcol-right.html

N1 at your local court. Preferred - fee exemption allowed.

4. Particulars of claim - N1 - hard copy version

Reading the above and having informed choices so your confident and know what suits you is why I have added the information, so you can ask questions.

I PERSONALLY BELIEVE THE N1 IS BEST

Happy reading and all the best with your claim!

CJ

Okay well after my first real look into the next stage, I can see that its best to fill out the relevant forms and hand them to my local courts

RATHER THAN

Completing the MCOL.

Is this correct?

If you have excel then I suggest that you complete the spreadsheet for bank accounts in England - Advanced.

It isn't as bad as it sounds and if you put the charges in one sheet it calculates the interest for you. The instructions are on the front page of the spreadsheet, but holler if you get stuck.

Chloe,

Thats great.

The only problem I am having is the spreadsheet. I have no idea as to how to tackle this. I dont want to complete it wrongly and look like a fool in court etc etc.

Hey CARO,

Can you confirm when filing at my local court do I produce the following:

  1. N1 Form
  2. Spreadsheet of charges including 8%

Do I need to send a letter to YB as well? Responding to their last letter?

Any help greatly appreciated.

:p

I suggest that you take 3 copies of each, keeping one for yourself, and the 2 copies for the court, one of which they can send to YB.

If you are talking of the standard fob off letter from YB, I see no need to respond as you told them your requirements and what you would do if they failed to comply in the LBA. You are simply doing as you stated.

Have you sussed the spreadsheet OK?

Ok i see, thats great.

The spreadsheet seems okay I think I have sussed it. As I go through I will post any problems.

Fingers crossed.

Do you happen to know what the time scale is from subbmitting the claim with the courts tio getting at least the first offer from YB?

Cheers

How long is a piece of string? Some people get an offer before going near the court, albeit for a fraction of the amount being claimed.
