Firstly may I start by saying what a great site this is. If i am successful in my claim i will defiantly be donating to the worthy cause.

 

Story so far.........

 

1. Called my local YB branch :

 

They instructed me to bring down my Data Protection Act 1998 Subject Access Request and payment and stated they will arrange for all transaction details to be sent to me. I requested at least 6 years worth.

 

2. I have just been on line and extracted my transactions as far as I possibly could (07-07-06). So far there are a total of £262.00 in charges made up of the following:

 

CHARGE DEBIT - £25.00

 

 

 

DEBIT UNAUTH O/D FEE - £8.00

 

 

 

 

 

 

Am I right in thinking these are okay to claim back? As far as I am aware these are the only types of charges that YB have ever charged me.

 

If the £262 is any thing to go by I should be in for a fair old claim

 

Any help or suggestions greatly appreciated.

 

Will keep this thread updated as and when the information / correspondences arrive from YB.

Hi rich, welcome and good luck with your claim. YB seem to take the full 40 days to send bank statements, i got fed up of waiting and went into my branch and the girl behind the counter said she had seen them in the office out tray so she fetched them for me, obviously they were there waiting for the deadline before sending them.

I don't know what charge debit is, on my statements iv' e had Unauth O/D Fee £8.00 as you have but not charge debit just, Charges, and debit interest. Iv' e claimed back all Charges and Fees but i didn't claim the interest as you have to work out what portion is down to your overdrawing, i think there is a spread sheet in the templates section to do this, but i will be happy to get my charges back so i just used the basic Excel sheet.

It all seems quite daunting when first starting so keep reading the FAQ's and the forum and you'll be ok.

The £25.00 Charge Debit is what YB charge per month if you go over drawn.

 

i.e If I went overdrawn once, I got charged the £8 plus £25 at the end of the month.

 

This is absolutly crazy. I have asked for an over draft to cover a small over drawn amount of say £100, baring in mind that my salary is 25K+ and there answer was NO!

Handed my Data Protection Act letter in person at my local YB branch.

I also receive a receipt for it to.

So now its time to sit tight and wait for there response which should hopefully be a pile of transaction including a massive amount of charges.

you will probably be very suprised exactly how much they have taken from you over the 6 years ..personally i was gobsmacked to discover that over 6 years yorkshire bank had fleeced me for just over £600..there are people on here who have been deprived of even more..good luck with the claim

UPDATE:

Handed my SAR in at my local branch on Monday along with the 10 pounds.

 

Received a call today from YB Head Office, 12-01-07 stating they are dealing with my request

 

HOWEVER:

 

They have to send the letter back to my local branch so they can verify my signature. Then my local branch has to send the letter back to Head Office, which will take 3-4 working days.

 

 

Is this the norm ???

 

Or are they just wasting time etc?

They are required to verify your identity under the Data Protection Act before sending your personal data. But this does not stop the clock in terms of the 40 days.

Hi guys,

Following on from the above and the phone call I received saying they needed to confirm it was my signature on the letter SAR.

I still have not heard any thing, but more importantly my local bank has not received a request to confirm my signature.

I asked my bank for contact details for the relevant department who will be dealing with this request, where ever they may be in the UK.

They told me they didn’t know. !!!

Does anyone have a telephone number for the offices where I may be able to speak to someone about the where bout’s of the letter etc and also to ask why haven’t they sent the letter back for confirmation of my signature.

Does this make sense?

UPDATE:

Well the bank has now received the letter back and they are processing it, as i write this note.

 

Im a little less worried now as i have heard stories of letters going missing etc in the post.

 

I also have a direct contact at my local banch who is dealing with my request / claim.

 

which gives that little extra confidence to.

Received a letter from:

Advice Quality Unit - Charges Section

 

The letter states that they confirm they have the £10 fee.

 

They will be providing me with copies of my statements as per my request

 

There is no manual intervention on my account

The manual intervention bit seems to be what everyone gets told so don't worry about it. It shouldn't be long now and you'll be needing to get that highlighter pen out to mark all those charges off :p

YB have until the 4th of March to have the statements on my door step otherwise the 40 days are up.

Is there a letter I can write as a gentle reminder to get them to send out the statements?

nope, not really, give them the full time, they will send them. Maybe last minute, but they will send them.

YB have sent me a letter stating that I will not receive my statements in the 40 day period as they have received a high volume of requests in relation to this high profile issue.

 

They have stated that I am okay to relay this message to the Information Commisioner. (well thanks very much)

 

What are your suggestions guys?

hiya, think we are at the same stage, just to let you know that 2 days after receiving the letter asking for more time to send out my statements, I got them!

 

Its just over £550 Im claiming, and just going to get my butt in gear and write the letter up.
