      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

From what I make of this "router Account" its a name they give to any figures they come up with and are completely rubbish they contain information of what RBS actually do with accounts figures, manipulations, but then when questioned about them say you are not entitled to them because they will be found out on a massive scale of false accounting and creatrion of false accounts.

They do not want them brought out into the open.

I would get your router account and compare it with the bank statements you have, check and double check ,I bet you will find they do not balance or correspond with each other, you will find entries on certain dates that do not correspond with your bank statements and that will be another false accounting case.

Agreed, These accounts contain interest on court fees ect they're also manipulated in respect of misappropriation.

 

In your case i cannot see any link between the router and your account.

Sparkie: I tend to agree with you there.I work in litigation and beleive you me I know what im talking about.When a case is closed the data cannot be destroyed until after 6 years after the case is closed so you are absoultly correct in that regard.Without going to the law books I beleive this is covered by the Limitation Act(1980) and the Data Protection Act(1998).So yes the records are covered under law until 2010.I closed a file on Friday so that file cannot be destoryed until 2013.It amazes me that the banks and finiancial instututions are flouting the law when they know darn well that they have no chance when it gets to the court room.Wilson vs First County Trust(COA 2001) is a prime example.

Sorry I do not understand the relevance of the Wilson case in records being destroyed? Perhalps I am taking it out of context as this issue concerns my hearing on Friday...Cobbetts are going to defend and so I need all the correct ammo in the right order to make sure I win...

Hello

 

I am a new member here my proplem with RBOS. It is actually a dormant account for last 3 years i never used it. it is a cash card account and another bank offered me current account around 2005,so i stopped use them tough it is still open. at 2005 i moved to a new address and i certainly remember i changed my address with them too along with my other bank and utilities address. at that time there was 15 pounds savings in my account. previous year i got a contract with RAC motoring services but i did not renew it, because i sold my card. Still RAC asked money from RBS thorough direct debit without let me know. They did not pay RAC for their was not enough fund in my accountand charged me for 28 pounds and send a letter to my previous address. They deny that i changed address.

Because of i did not get their letter i did not pay this money and they kept me charging every month another 28 pounds plus escalating interests ( 1.04 pound first month second month 1.43 etc), after around 10 month in april they called on my phone and asked me to pay total 271 pounds

I told them first why they did not send a letter to me at first hand but they deny that i have changed the address. i told them it is obviously a dormant account for there is no activity in it for last three years and these charges is unlawful. She threatened me to send me bailiffs. I told her first close down my account, because i do not want to work with them. She refused to do it and said she would keep till i pay them fully. Plus she said she keep charging me every month till i pay them fullycan she send a baiiliff to me straight away without a court order, and what should i do? please some help and ideas.

If the RAC annual payment is made by credit card then it's often a rolling charge taken each year from the same card without further ado

 

However before setting up such an arrangement they are supposed to get the holders agreement & often they don't
