    • Hi and thanks It looks like they ticked all the boxes to me but I'll try and upload the notice. I was wondering if a witness to late delivery might be considered proof - I'm assuming they posted it as normal but Royal Mail stuffed up delivery. If not then they're really saying it just has to be posted within 12 days of the incident, regardless of when it is received.     • ROFL - dont get upset just because someone (quite a lot of someones) dont want smart meters - well unless you get paid for it .. in which case ...   I assume you haven't been with Octopus long enough to be on one of the very long fixed price tariffs they offered before the prices went bonkers .. and that you dont use your electricity in the evening/lunch time if you think the 'agile type tariffs are good value .. let alone worth installing a smart meter for - high price a good disincentive for an evening cuppa eh? Let alone all your computer/tv etc time in the peak price evening or lunch time. - and boy do those peak prices instantly hammer your bill when those Russian and middle eastern issues kick off.   I would only have considered a smart meter if solar panels had been an option for me - but roof is oriented completely the wrong way. Oh - and My opinion hasn't changed since the smart meter trials 40 years ago, because neither have the issues (well not enough) but I'm happy for you. Be happy for me.

    • His financial situation isn’t great, and the landlord has made lots of things up. The things he’s put isn’t true at all. My friend did tell the full truth with incoming and outgoing, I helped him fill in his form and he checked bills etc. to make sure it was right. His wage is ok, but not as good as the landlord thinks it is,  and he doesn’t have anything spare. How much are they likely to take from him? Should he send any reply?  the letter just says to take the court letter with him.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi there, i am new to all this i hope this works, my story is the nationwide have been taking from me for years and after reading through your site ( and others similar, although i thought this was best!1) i decided to take them on! i am at stage two i have asked they repay my money but funnily enough ive heard nothing back yet,( only posted it two days ago!!), they r playing funny beggars though i requested statements from both my accounts and they only sent me one set!

Hi and welcome to the site,

You've definately taken the first step into claiming back what's rightfully yours.

 

Spend time reading the FAQ's and the Step by Step guide as this will stop you making mistakes along the way. Use the letters and spreadsheets in the Templates Library as these have all been tried and tested in successful claims. Read as many threads as you can especially ones that relate to your bank. This is a SELF HELP site and won’t do the work involved for you. However, everything you need is on here somewhere.

 

Don't be afraid to ask any questions, no matter how stupid they may seem, but please remember that any advice that you receive is normally based on experience only and that you should seek expert advice if required.

 

Once you start the process of your claim remember to open a thread in the relative bank forum, this will enable you, and others helping you, to keep track of your claim.

hi all, i am new to all this but after much thought and reading!! i have begun my fight to reclaim my money with nationwide, i have just sent off letter requesting my money back so we will see, i am still slightly confused about which court i would have to go through as i live in scotland, and i requested statements for two accounts and they only sent me one lot, they r still within 40 days so do i just wait and see if the others come and if not do i report them? help!

Why don't you send them a reminder that you need statements for the other accounts. They are very busy and may just have missed that you put two account numbers in the DPA letter.

hi all, quick update from nationwide and me, i got a letter from them today saying that they would forward my letter to the correct dept( thought i had sent to correct dept!) so do i keep to my timetable or do I allow for letter to get to right place?

oh dear i think i have messed up!!!!

when i sent letter requesting payment back i sent lba by mistake according to that letter i sent i told them that i would be taking further action and would begin a claim against them!! i think i have jumped the gun, they sent a letter today which said they thought the charges were fair and if i wasnt happy i could get in contact with financial ombudsman blah deblah.... what do i do now can anyone help?????????:o

hi all i think i may have messed up here is my story so far;

i got my statements and sent away letter requesting they pay me back the charges, i recieved a letter from them today saying charges were fair and so on, however i have just realsied that i sent them the lba, now i am very unsure what to do as in the letter i have sent them i said they had 14 days to pay up or i would be filing a claim against them, what do i do now??????? i know i jumped the gun but do i send another lba or go straight to mcol? please help so confused and i could kick myself for my stupidity ( honestly i read all the faqs) but i still messed up!:eek:

Don't worry

The 'BBC' recommendations are to send what is in effect an LBA from the start thus by-passing the preliminary letter stage. As far as I can ascertain from the BBC website it always works for people who follow that procedure. I would say it's preferable to appear reasonable and allow an extra 14 days with the advance notice of the preliminary letter as per guidance from this forum...........but what's done is done.

You should get what's rightfully yours 2 weeks sooner!!! Good luck

I got the same letter from them today so thanks for this post lori. I will be keeping an eye on it. Can anybody out there help us please??:?

Hi lori, i decided to write to them today and let them know I wasn't happy with their response and if they couldn't come up with an acceptable solution i would be going to court to recover the charges. They have 7 days! Will have to do a Summary Cause as far too much money at stake to go through small claims. Court forms seem a bit daunting tho. :o

i have decided to go through mcol, i have an english address i can use my claim is near 4k this is just for one account!! they have still not sent me the statements for my main account, if i get the charges back for this account can they stop me claiming for the other account? im soo confused:confused: if anyone thinks im daft do not hesitate to let me know

Let me know more if you do sue for non-compliance. I haven't recieved statements for my bro's credit card from Natwest. He's calling tomorrow and if they don't get here sharpish I'm not sure how to proceed. They sent staements for his bank aco**** real quick.

Hi eveyone,

 

I'm at the LBA stage myself after trying to reason with them both in branch, over the phone and then with a preliminary 14 day approach letter. my question is this, my claim is very small, only £90, what are the chances of them returning my charges at this stage in light of the smallness of my claim and if they don't how do I go about starting my small claims proceedings as I have resolutely resigned myself to being my next planof action as stated in the LBA.

hi there, from what i have learned from this site the chances of them paying up are very slim, looks like u will have to go through small claims, you can claim through mcol which is done online, i am not exactly sure what is best for u i am in scotland and things r slightly different up here, have a look at other threads where people have gone through small claims you will find all the information you need on this site, it is just a matter of looking for it im afraid look through the guidance notes this should help put you in the right direction.
