Hi

Six months ago we received a red Mackensie Hall postcard to our old address on a post re-direction. I looked up the advice on this site and ignored the card. I havent heard anything since until today. We have recieved a second letter which says our account has been passed to Meritforce Doorstep Collection and they will be coming to the address on 10th January. At the top of the letter it says 1stcredit: Barclaycard v (our name) and a threat saying if we dont contact them they will start legal proceedings. Could you advise if i should just ignore this letter too? since they will be visiting our old address? what will happen next.

Very worried about this any help would be greatly appreciated.

Thanks

i wouldnt do alt at the moment and if you have recieved any further letters at the old add mark them as moved return to sender. This way they will not go to your old add and start looking for you at another add. if you keep on retaining these letters then the dca will know one way or the other that somebody is reading these replies and could possibly contact royal mail and ask for your current address.

hi adrian

you stand more chance of winning the lottery than getting a visit,

so do bother with the tea and crumpets

by chance any body does turn up, tell them to sling there hook, they have as much power as the milkman

its all mind games for which they are very good

it to get you to phone them

remember every thing in writing

never, never, never talk to a dca on the phone

Hi, Ive just received the same letter from Meritforce saying I will have a doorstep collection in 10 day, it says their client is the Lowell Group, on my credit report I have a default from Lowell dated 25/05/05 for the same amount meritforce are asking for.

This debt I can only think is a capital one card I had back in 02/03 and the debt was about £200, as I kept getting charges I couldnt ever get rid of it.

Should I respond with a letter not acknowledging the debt and ask for a copy of the credit agreement? Im not sure what's the best thing to do here?

Thank you so much for answering, very much appreciated as I'd love to get this off my credit record anyway to be honest, as I cant even rent a house through an agency because of it at the moment. Very helpful, thank you.

Hi Sav

You say it's from 02/03.

Could the "statute barred" option be open to you?

If you have a six year period where you haven't paid to or acknowledged the account this could be an option.

Hi brenda

They are pretty much the same company.

Do not panic.

Spend some time reading around this forum and you'll soon be reassured:)

Do you have any history or info about the alleged account, ie payments made, actions so far, dates etc?

Has anyone actually had an "authorised collector visit" because mine is due shortly once i have ignored their deadline of july 2nd. I'll be disappointed if i don't get one as i'm looking forward to telling him to "f*&$ right off", then once he has meritfarce have stated on the letter that "no further reminders will be sent" so if they are a company of their word it must be game over with them!!

Who next???

Ruthbridge??

Some other lowlife chancers??

Mackenzie Hall are well known for chasing statute barred debts, if this is the case then do send the statute barred letter number 2 from here - The Consumer Forums - Debt collectors - If you are in Scotland then it will require a different letter - (number 15) - Once you state that you have no wish to pay towards a debt that is statute barred they MUST stop collection as it can be construed as harrassment - The OFT have recently placed requirements on Mackenzie Hall - The Office of Fair Trading: OFT imposes requirements on Mackenzie Hall to improve handling of disputed debts

Hi i have just received a letter from meritforce offering me a 33% discount saving me £4000 if i pay up in 7 days. i cant so i wont. They have also said this is the last letter before action court etc i have been through the doorstep collection letter nothing happened. They are also offering me the chance to pay £25 a month until the loan is finished bearing in mind this is a loan of £12,000 so it gonna take a long long time. I half just want to pay the £25 a month to get this sorted because i really dont want to end up with a ccj but then im worried they will raise the bar after say 6 months and demand more and more cash.

Anyone have any advice.

Thanks

Hi Kurvaface, i haven't yet have all my other creditors though. The problem is i actually made a payment of £20 to mackenzie hall about 2 years ago so not sure if i admitted liability by doing that. Another question are they allowed to join a credit card debt and an overdraft on a current account together. This is what HSBC have done before sending in mackenzie hall who then sent in meritforce.

Thanks for your help

If your account was already statute barred the 20 quid makes no difference. If you have had a six year period in which you have not acknowledged or paid into the account then it is statute barred.

You should cca the dca because that is where all the terms and conditions are that you MAY have agreed to. No CCA... no pay.

Mackenzie hall credit license does not allow them to trade of canvass. Also ive tried searching for meritforce on the OFT Credit license database and can find no record of them. So basically in order to act as baliffs or send round field agent/collectors (all of which are baliffs in my view), then they are required to have a credit license that allows them the right to trade of canvass. to do so without one can be seen as harrassment and/or intimidation. Or at least that is my view of the legalities
