Hi started my claim just before Christmas. Went into my branch and asked for 6 years statements saying they were for my accountant and recieved them about 10 days later.

Sent of first letter recieved reply saying the usual they will look into it, 28 days blah blah blah.


I sent off my Lba on the 28 December and am waitng for their reply.


Why I am posting this thread is that I am concerned that they will contest my claim. The reason for this is that most of my bank charges have come through unpaid direct debits or debit card charges not having sufficent funds, due to me gambling online.


That has been a problem that I think I have conquered, but I am just concerned they will say I have run my account recklessly.


I am claiming back £1400. Any veiws greatly appreciated, but not about the gambling as I Know I have been a :evil: :evil: :evil: :evil:

The reasons for you incurring charges are completely irrelevant. The only relevant facts are that you breached your contract and they charged you a penalty for doing so. The court will not be concerned with the reasons you breached your contract.
