Just about to make a start on reclaiming back bank charges. the only problem with the account im going to try and reclaim is i am in the process of paying back an overdraft at so many £'s a month, so the account is closed really will this make a difference?

hope everyone is well :)

Hi and welcome - no difference at all - in fact you have a slight advantage if anything since they can not even threaten you with account closure!

Spend as much time as you can reading through the materials in the FAQ section, then start a new thread in the bank section and update us on your claim.

Best of luck

Caz, can you confirm if you are talking about Clydesdale or another bank on this thread please

Can you confirm that a trust deed is to do with your debts being written off in Scotland? Also can I ask if the information regarding not claiming due to the trust deed came from someone on this site. It isn't something I know about, but I think it may be worth you sending a SAR for all your info from Clydesdale. If your charges were higher than the amount written off I think you could have a claim, but this needs much more investigation. I think it may depend on what was agreed with the trust deed.

No precedent has been set and there may be an appeal in that case so carry on as before. Lloyds got lucky with one judge, but thousands of other cases have been lost by them. This was newsworthy because it is an event as rare as hens teeth.

I'll move your thread to the Lloyds forum as it is really about that claim.

I'm afraid I haven't managed to find out more about the trust deed issue, but I haven't forgotten about it.

The thing to remember is that the charges are unlawful, so I can't think of any circumstances where they should not be paid back, contrary to what the judge in Birmingham thinks.

Got a letter fromTSB today.

I have already had statements and also sent away letter claiming for charges.

"Thanks you for getting in touch with us. I am sorry you are unhappy aboit your account charges".

It goes on to say about the charges they have for overdrawn and not having enough money to pay dd.

at the end of the letter it says

" I do hope you can see that we make our charging system as fair as possible - and why i can't agree to cancel charges.

If you have asked for a copy statements and paid the fee. We will send them to you within the 40 day limit set by the data protection act.

If you have not yet sent the £10 fee you will need to send it to us at the address below. the 40 day limit starts from when we receive your payment.

I hope this fully answers the points you raised with us. please let me know if there is anything else i can do to help. If we cannot come to an agreement, I will provide you with details of the FOS so they can consider your complaint independently.

If you are happy with the way I have dealt with our complaint there is no need for you to replay to my letter. If i have not heard from you by the 26 july 2007 I will close my file, though of course i will re-open it should you come back at any point afterwards."

do i send a letter saying i have already sent away 2 letters?
