before i send the preliminary letter i have to point out it clearly states in the contract with the bank and on the back of each letter they send me (charge) that un authorised over drafts not arranged prior with the bank you will get charged £30

 

so as this is a signed agrement doesnt this mean i am in breach of contract also? i have read the facts and figures and would just like to get this cleared up before i start my claim

 

also on phone banking they say they can take the ten pound charge and send the six years of past statements instead of writing in to them.

Hi

I think we all at some point must have signed a contract with the bank, but if you look at all the successful claims it doesn't seem to mean anything. I would just proceed with your claim.

I am fairly certain this question is answered in the FAQ's. Please do not think I am being unhelpful, it is just that my typing is of the two finger variety and it will be quicker for you to read the explanation therein, than me to type it out.

I feel my answer was not particularly helpful and whilst my typing has not improved in the last 2 minutes, i have just checked the FAQ's and the answer you need is within the 'can i claim' heading. Sorry i do not know how to provide links..
