    • Perfect, thanks Dave.   You're right, a whole dodo storm this has been. As sons of first-generation immigrant parents, whenever something like this happens the old man panics. There was a whole "appeal this now" because my dad paid for the parking as he was with the hirer at the time and he isn't as tech-savvy as my brother so he ended up doing what he did and because I don't live there anymore it came all the way down to this.  But yes, we'll do this SAR and see what comes of it.  Will keep posting here with the hopes that it may benefit someone in the future.  Thanks again, everyone.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,would just like to let yous know have just checked online banking and halifax have paid my second summery claim,so can a moderator move it to the won section please.I will also make a donation once i find a way of doing it,as i dont have a debit card or credit card.Thanks again to this great site,off to start 3rd claim them 1 small claim to go.:D :D

Hi All

Haven't posted for a little while so thought i would update,i have filed my 3rd summery cause claim with one more and one small claim to go,so thought i would give halifax a phone on wednesday to see if they would be prepared to just pay it at all at once and lo and behold they said yes.so am waiting on letter to confirm.Also i have been told my account is out of head office control so they have ordered a new debit card and cheque book for me,so at long last i will be able to DONATE to this brilliant site.Will post again when i receive funds,and good luck to all yous who are waiting.

Congrates.... Ive won mine also, but as prviously posted they were faffing around because i have an IVA.. alas in my case because of the IVA they idnt pay me, they sent a cheque directly to my insolvency practitioners.. and guess what they said.. thanks very much we will add it to your estate!! so even though i won.. i wont see any of it.. despite it being in my contract that they can have 50%..

 

Have stareted ball rolling now with Nationwide, but they werent involved in IVA so Sshhhh and also sent off for Halifax credit cards x 3, lots of charges there.. but like the last they will send it to IVA, but it reduces my debts so im not that concerned..

Can i ask if you signed the acceptance form they sent you as I sent a letter of acceptance which they refused to accept as the conditions on it was that they could apply future charges.They have rfused to refund the funds of £1,718.00 due to this

Should I just sign and post there acceptance form they claim agin for other charges

In reply to your post,we haven't received the acceptance form yet but will only be signing it if the conditions suite us.We have another 2yrs to claim from bos as we only put our first claim in from when Halifax merged.so will be going for more.All the best with your claim.
