    • Yes, await the Directions Questionnaire from the court. No, the Directions Questionnaire is just a short form and leads to the case being transferred from MCOL/CCBC to your local court.  If you Google "Form N180" you can see a blank copy on government web pages.
    • There will only be one hearing (typo possibly 25th is a Saturday Courts closed ) clarify with the court.

    • No Andy, I'll scan, redact and upload later today. So the court sent me 2 letters, same envelope and stapled together but with different dates!. 1. N24 General Form of Judgement or Order, stating: UPON considering the papers herein IT IS ORDERED THAT The claim is listed for an attended hearing 25 May....... at which court will consider allocation..  etc   2. N24 Notice of PTR/Adjnd/Restored/Hrg/Management conference TAKE NOTICE that the hearing will take place on 24 May at....... When you should attend 30 minutes has been allowed for the Hearing   No other instructions anywhere in the envelope or on the letters. Do I attend both?
    • Then leave it just proceed with the claim( strike out/SJ application are risky).....the defendant will not be permitted to rely on written evidence (documented) only verbally as they failed to comply with the N157 (unless they have filed with the court and failed to serve you a copy) ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi folks,

this site is just what i have been looking for,

so hear goes,

first i have a abbey account i think i have some books that go back over ten years,

how far back can i claim?

Can i claim for interest charged while within an authorised over draft?

 

i also have a payment protection plan problem with a halifax personal and loan.

 

any links or help would be great.

HI and welcome

 

First of all go straight to FAQs and have a read and read all you can! Then strat a thread in the Abbey forum, where you will get great advice from others who have gone through or going through the same process.

 

You can claim back 6 years and yes you can claim back interest but you really need to rad the process thoroughly to ensure you do this correctly.

 

PPI with Halifax, have a look at the halifax forum on here and see what other have done, and again read read read!!

Well hello and welcome this site is great and gives you all the info you require, firstly you can claim back 5 yrs in scotland, 6 in england, you can claim interest (contractual) as you have been charged or settle for the judicial rate of 8%, that is your choice and you would be wise to read a few posts before deciding which route to take.

At the moment the Limitation Act only allows you to claim back this far but the Act itself is currntly being challenged although there has been some success this is due to settlement out of court.

I found myself and my family in a desperately dire financial position when I had a near-fatal road traffic accident 4 years ago. I have been unable to work for some time.

 

Despite serveral phone calls and letters to our banks, First and Abbey, we were still charged for overdraft and unpaid direct debits. And we also found ourselves living off credit cards!!

 

To cut the story quite short, First Direct finally served a default and closed our account and demanded to pay back over £3,000 immediately. We could not as we were running a monthly deficit. It did not stop them from handing our account on.

 

I was offered a substantial out of court settlement for my accident (3rd party).

 

It is now my mission to get justice; a) from both banks by claiming back a full six years of charges and; b) not paying back the full amounts required by the credit companies because the are acting unlawfully by pushing credit onto vulnerable customers!

 

So far I have got £900 taken off the balance that First Direct had passed on to another credit company and I paid the remaining balance in full. I have now received my full six years of bank statements from First Direct ( and I must say it really is a waste of paper), I am claiming back all charges related to this account, 100% or more!

 

Abbey next!

 

I have been successful in offering two credit card companies 50% of the remaining balance too. I did feel really bad about this but I am now coming to terms with this as I am still being offered credit cards left, right and centre! VERY UNFAIR and perhaps unlawful?

 

It is time that we stood up to these unlawful capitalist institutions that profess to be service providers, for the sake of our children and young people.

hi guys,

been browsing threads and faqs, as i have both bank and PPi claims with both abbey and halifax.

does any one know if mortgage account charges come under the same principles? read the faqs i people say

 

after reading various samples and templates, have come up with this version or the S.A.R - (Subject Access Request) letter for abbey;

any comments please feel free i should be sending these out in a couple of days.

its a bit long winded but i think it covers the microfich etc...arguments
