I am in the process of claiming back bank charges through county court - bank filed a defence AND put in a counterclaim for £109 worth of charges previously refunded to me as goodwill gestures - anyone come across this before?:confused:

Please let me know which bank you are making your claim to. I have just started mine so it would be good to know?

Counterclaim? the £109 which as you stated was a goodwill gesture, was this cashed by you as often this is seen as a full and final settlement of your claim.

It's a small Cumbrian, member owned building society - I guess they may not be "au fait" with the consumer action group!:rolleyes:

George - £109 was several charges at different times when I contacted them to complain

Were the £109 refunded but yet still included in the claim. If you have then you do need to deduct refunded amounts

Yes you need to do as natweststaffmember has said, or provide proof that you are not claiming any more than you are due, wouldnt be surprised for them to have counted up wrong but youd be best to double check your own figures.

The £109 charges were 5 separate charges on 5 separate dates between 01/2002 and 05/2006. They were refunded (reluctantly) after complaints from myself, back into the account. I haven't included these on my claim so can they actually counterclaim for "goodwill refunds"? Goodwill refunds are their words, not mine.

If these were not in your claim, then the simple answer is no they can't counter claim. This implies that you are claiming for something that has been refunded already

That is the way i see it, as i said they are foolish bankers and this is something they cant even get right.

As long as the counterclaim is only for the £109.00 that you were refunded and that your POC dosent include this amount. I personally wouldnt inform the bank of this because they will look so stupid appearing at court after you reveal your defence to this, embarrassed id think.
