Any help here would be appreciated

 

I have sent off my preliminary request and recieved a phone call offering six months worth of charges back... this i declined and sent my LBA

The deadline for this ends on the 08th May but I have today recieved a standard letter from halifax confirming they will not be settling my claim and sending me details of the ombudsman.

Do I now need to wait until my original 14 day deadline or can I file straight away due to the fact I have recieved this letter from them?

 

I am claiming just over £800 of charges so I want to make sure I do this right

Best to give it the 14 days. It will look good on your part should it proceed to court...

Halifax preliminary letter sent 17/05/06 charges £2661.00

Bog Standard blah blah blah letter received 22nd May 2006.

received lengthy letter dated 24th May 2006 offering £605 pah!

letter before action sent registered 5th June 2006

letter received in response to lba offering £1801.00 errrrr no ta

court action filed 23rd June 2006

deemed served to bank on25th June 2006

notice of acknowledgement of service has been filed

they intend to defend

7th july received letter PAYING IN FULL!!!

 

10th July cash deposit £112.58

10th July cash deposit £2869.00

:D :D :D :D

 

HALIFAX SETTLED IN FULL

OK I waited!!!

Now I have filed claim with moneyclaim, I did this on the 10th May. Do they have 14 days from that date to respond.

 

No. In a couple of days you should receive confirmation from HMCS and it will say on there that they deem the claim to be served on x date. That is the date to start your 14 days from. Good Luck!

Sit tight, you'll receive notification from the court.

 

Halifax will probably say they never received it, huff and puff a little and then you should get yor money...
