Hi all -- I "purchased" two lots of vouchers from an ebayer recently. One cost £450 and the other £420. Each transaction was covered up to £500 via the paypal buyer protection, so I thought given the above I would be fairly safe. They were two separate listings from one seller. The seller had excellent feedback (over 500) but she conned me and several others and never sent anything!! I progressed to claim via paypal. I won the claim, but was only granted £500, because I paid for them both together. I believed I should have been fully covered for the total, as each separate item was covered for £500. I'm in a wrangle now with paypal to get the other £370 back. I've sent several emails to them, asking what help they propose to give, as if they can't get it back for me, then I need to report to the police as fraud in an attempt to reclaim the £370 still outstanding from the seller. Anyone had anything similar or could give me any advice.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

All in all, quite busy at the moment and enjoying every minute of it

Without trawling through all the of T&C's of Paypals Buyer Protection Policy I can't answer your question but if it has been paid for in one single transaction rather than 2 separate invoivces it may be seen as 1 transaction, if you look at the general consumer board here: http://www.consumeractiongroup.co.uk/forum/general-consumer-issues/ there are some ebay/paypal cases on there or even on the ebay community forums themselves you see cases like this often.

 

My personal feelings about ebay is basically not buy something of high value, some use Credit Cards so they are covered, did you use one in this case as they may be able to help you make a chargeback??

Hi - thanks Cheddar - the payment was made part from funds in the paypal account and part from my debit card linked to my current account (eek the Halifax account that I'm presently trying to claim back charges on!!) What I'm trying to get across to paypal is that each item was covered by them for up to £500, but I did pay for them together. Ebay actually ask if you would like to pay together, and as it's easier to do so, I did! Perhaps if this is the case, I should put forward to ebay that they should warn people that combining transactions means they'll not be fully covered in the event of a claim!!! Will keep trying ...

Do let us know how you get on in the forum i posted above, sadly paypal/ebay policies and T&Cs are very long and may contain information you need at a later date, but I appriciate that not everyone reads things all the way through. :S Good luck :)

Hi, did the seller have a pay-pal shopping basket checkout?

 

Reading the T & C it looks like one claim per transaction especially if they use a checkout system provided by pay-pal. You can have multiple items, it looks like £500 per per claim to me.

 

Maybe you could study the details about pay-pal from my ebay.

I checked out and paid for the items together, unfortunately. It seems paypal and ebay are one company when it suits them, but they then refer to separate terms and conditions when challenged! Cannot win!!!

Hi,I've got to say I've been buying but mostly selling on eBay since 2004 and have never had a problem with Paypal,should you be interested the number you can contact them is:- 08707 307 191...you will need to provide security info so have your e-mail address,home telephone number and the last 4 digits of the credit/debit card that you use to trade with...II have only had to phone them once or twice but always found them helpful....hope this info helps.

Hi guys -- having trouble now with my old Paypal account and NCO!!!

 

I had this account a while back and was the victim of a fradulent chargeback which left me minus £99. NCO are now chasing this!! They left me the "Calling Card" and rather stupidly I rang them from work. I did say that I'd like all correspondence in writing and that I disputed the debt with them. They said more or less pay or else!!!! I said I was in no position to pay, but may be in a position to pay at the end of January, provided I had proof of the debt.

 

I've had nothing further through the post, but have been called several times at work!!!! I sent the "telephone harrassment" letter on 15 Feb and have been called back twice since then - 16 Feb (ok they wont' have had the letter by then) and also yesterday (22 Feb).

 

What should I do now guys - any advice? I didn't send the letter recorded delivery, I just used 1st class. I think I should perhaps send the letter recorded at lunchtime and then ring them when I get home (our new home number shows as "number withheld" when I dial out so they cannot get my home number!!) stating again that I want all communication in writing.

 

Any comments would be most appreciated.

 

What really makes me sick to the back teeth is that I lost out £380 just before Christmas on an ebay/paypal transaction and yet on the other hand I'm a victim of a fraudulent chargeback against me and have to pay them another £99!!!!

 

I will not use PAYPAL again and would certainly not recommend them to anyone.

Hi, you could send for details of any contracts you have with them.

 

Dear Sirs,

 

Please be aware that I no longer acknowledge the above debt to your company, and therefore require you to supply the following documentation before I will correspond further.

 

Firstly, you must supply me with a true copy of the agreement you refer to in this matter. This is my right under the legislation contained within section 77 (1) and section 78 (1) of the Consumer Credit Act 1974 - your obligation also extends to providing statements of account.

 

I enclose a £1.00 postal order in payment of the statutory fee for the account as above.

 

You are reminded that you are obliged to supply these documents, whether you are the original creditor or not, under section 189 of the CCA 1974.

 

As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the Consumer Credit Act and therefore is a complete defence to any court claim that is issued.

 

Take note at this stage, that any legal action you are or may be contemplating may not be enforceable in law.

 

I am now initiating investigations with XXXXX into the validity of the original amount that was claimed to be owed, and will be in contact with you again in due course. In the meantime please be aware that I consider this matter to be “in dispute”.

Its well documented on other internet forums that NCO do not follow up any attempts to recover debt they hope to scare you into paying with credit/debit card. This also happened to me, i had a chargeback of 150 quid and i haven't paid it and told them so over the phone.

 

So my advice is to tell them to stick it.. and tell them the name on the note saying an agent is calling is ALWAYS THE SAME NAME FOR EVERY PERSON. i.e. Mr Parsons Saturday at 8pm

 

Do not worry this company have no bearing over you legally. You will do just as well to ignore them than sending letters. I have done the same after ringing them once and saying that Mr. X can't be in 100 places at the same time.

 

I for one hate Paypal for charging back immediately without getting my side of the story. For paying for games or cds i am sure its fine. I had used it for 4 years previous and i would never use out of choice again
