      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just totalled everything and it came to a sum of £786 so I just took a couple of charges of to maintain the £750 threshold.

 

I noticed that amongst my statements the year 2003 was missing. I was at University that year and taking a few dodgy substances but Iam sure 2003 DID HAPPEN.

 

From Sep 2002 it states "Account Renewed" then there is a gap and then another "Account Renewed" with a date of July 2004. Strange very strange..........anybody else come across this yet???

The Halifax are really good at this.

 

Allegedly the on-line system can only hold so many entries and every once in a while the file is flushed clean and a new one started. It's a right royal pain in the bottom when you're trying to keep things straight.

 

As far as the missing statements are concerned send a letter immediately to them pointing out their "possible oversight" and request that the missing list of transactions be despatched as soon as possible. Remind them that the clock is still ticking and that they have only XX days left to comply in full with the SAR.

They are quite helpful when the bank has failed to comply with a DPA request.

A similar position for my other half. According to their records, she opened an account with a balance of MINUS £150 on CHRISTMAS DAY!!!

 

There weren't any records going further back!

 

Funnily enough, when I pointed out that it is impossible to conduct transactions like that on Christmas Day they found another TEN years worth of transactions - weird eh?

Right a quick update and a few questions?

 

I have been sent 6 years worth of statements minus a year and a halfs worth. See previous post.

 

I added up the statements I had and it came to a total of £748. I wrote a LBA giving them 14 days to repay this amount. I thought i could go for any other charges incurred during the missing statements at a later date.

 

Do you think this is okay? Oh and my recorded letter hasnt arrived (according to Royal Mail)

 

Please give me your advice

Guys,

 

I phoned the Halifax 2 1/2 weeks ago after first receiving my statements.

 

The statements stretched back 6 years and so I started making my spreadsheet of charges. This came to a total of around £800 and I was ready to send of my claim.

 

However I noticed that I had no charges for either 2002 or 2003. Looking at my statements I noticed a "blip" in the statements which read as below:

 

6 Sept...Account Renewed........................................-573.11

18 Jul....Account Renewed.........................................102.00

 

I instantly got on the phone to Halifax demanding they send my statements and how the clock was still ticking on their 40 days. They said they would have it sorted and sedn out straight away. that was 2 1/2 weeks ago and Ive not heard anything until today. THEY HAVE SENT ME EXACTLY THE SAME STATEMENTS AS BEFORE with the same perios missing.

 

Iam becoming really disheartened by this now (prob what they want) and just want my money back.

 

Does anybody have any advice on this? And does anyone have a letter template I can send to the ombusman to complain. I really dont want to have to go to court to request statements as this will just drag the matter on again.

 

Do you think I should press ahead with my claim for the charges I already have evidence off?

 

Please please help

Ive decided to just send a prelim letter in respect of the statements I already have. And will follow up the missing statements by phone tomorrow. I will have to use the threat of a court order to get them to send these statements.

 

The amount I have applied for just now is £851.50 so i will keep you up to date.

Just received a letter from Halifax.....offered full refund of the charges I have been able to identify so far £851.00!!! The letter also states they have ordered the missing statements (which were omitted from their records seemingly) and they say they will waive the £5 fee for this (eherm what did you cash my £10.00 cheque for?).

 

So Iam going to go ahead and accept the offer but put a note in the letter how Iam awaiting the other statements to see if there are charges included in these. Does anyone think I may encounter problems with my 2nd claim for the period they omitted from their initial statements.

Came back from work today to find two letter from Halifax.

 

One contained a letter saying my statemnets had ben ordered and will be with me in 28 days (initial request was back in 16th Jan 07). The other letter contained one page of statements saying Balance brought forward (-573.11) and then on the next line the date (Sept 2002) and Account renewed.

 

What a help this is.

 

Iam going round in circles and feel I need help.

No £851 in my account yet.

 

Phoned for the 5th time yesterday and the girl said she would personally print of the statements and send to me first class.

 

This is their last chance before I go to court to make them. The girl admitted they are having problems with the dept that are meant to be sending out statements. Hire monkeys .........thats whats going to happen.

Sent for statements on the 16th January......finally got them ALL on the 28th April...........now thats a record.

 

If I have accepted the offer for the periods I had been given last month. Will there be any problems claiming the charges from these new statements that they have been regularly saying they didnt have?

Have you signed an acceptance letter yet?

 

They normally say 14 days until the payment will be in your account.

 

Obviously you are getting no where. So you will prob have to file at court. You can just keep adding an extra charges to your spread sheet until you file.

Update!!!

 

Went To The Ombusman With My Complaint And They Have Resolved The Issue For Me.

 

All Charges Have Been Repaid. After Contacting The Ombusman It Took Around One Month To Get A Decision.

Just Wondering.................I have signed my acceptance letter and told by the Ombusman they may take 6 weeks to pay this inton my account.

 

Can they still put this on hold after recent happenings?

They will still honour any agreements.

Just phoned the Halifax there sea-sidelady.

 

They have said that all these claims that have went to acceptance letter (and signed by customers) will be held until next year !!!!!!!

 

Is this right???? I feel another call to the Ombusman coming on if it is.
