Hi everyone,

Having read loads about determined people winning their money back and seeing a great deal of help coming from this forum I have decided to do all I can to get my own money back. Here is my situation:

I have been with HSBC since I 14 (am 26 now). I have a savings account on which I have a small overdraft which I manage to exceed every single month. HSBC charge me a ridiculous £ 25 per every transaction over my overdraft ( so for example if I go over my o/f and buy a pack of tick tacs for 30p I get charged 25!!!!). I have read theFAQ and other forums and am now at the stage of writing a letter to the bank to get some kind of idea as to how much I should claim. Here is my letter that I will send if someone can confirm it is ok. Oh and is this address correct for HSBC? THANK YOU ALL VERY MUCH!!!!!:)

My address here

Re: Account number XXXXXXX

Dear Sir//Madam,

I request that HSBC Bank Plc. provides me with details of all default charges - arising from exceeding my overdraft limit, not paying on time, or not honouring a payment - I have paid in the last six years.

I understand that HSBC Bank Plc. is obliged to provide this information under the Data Protection Act 1998. Can you please ensure you provide me with details via copies of my statements.

I look forward to hearing from you within 14 days.

Yours faithfully

Nemanja

That looks fine Nemke!

Jsut add that they have 40 days to comply and make sure you send a £10 cheque - they will send it back, but it's best to be safe than sorry.

I will try to read again but I moght not be able to get online until this evening! Please retype the letter and repost it and I'll check over it!!

Good luck!

I sent the request without the tenner by post but sent the same letter by email (yesterday) to hsbc through my on line banking...got a reply today:

Dear Mr Borjanovic

General Enquiry

Thank you for your e message received 02 January 2007

I confirm that I have ordered copy statements for the last six years as requested. You should receive it by post at your statement address within 10 working days.

Kind regards

Ajith Chandramohan

HSBC Internet Banking Customer Support

Now this letter says that they will send the last six years' statemens but I thought they would send a total figure of all the overdraft charges....does that mean i'll have to get the marker out and highlight the charges and present the bank with my own estimate...of course I dont mind doing it but is that the best way. THANKS EVERYONE!!!!!:D

Yes you will have to work it out for yourself, i also suggest that you startv a thread in the HSBC forum so you can chart your progress there and people can help you if needed. Also use the template letters on this site. :)

yes nemke, you need to go to the templates library on this site - start a thread as mentioned above in the hsbc forum and post there, let us know what it's called (unless Cheddar can aarrange to move this one?!) and we can help you step by step.

Hiya,

HSBC are normally quite quick to be honest, esp in regards to getting statements to you.

Once you have your statements, choose a spreadsheet from the Bank Templates Library and then highlight ecah charge and enter it on the spreadsheet, it will calculate the totals and the interest for you.

you can claim anything back, unless it is a charge for a sefice i.e. banker's draft charges or cash machine withdrawal charges. If you're not sure what you can/can't charge, post here and we will help you.

Then send your prelim letter (from the library) and then it all starts!

Send everything recorded delivery and keep a copy of every letter you sent, keep them all in a folder with each letter you send and receive.

Guys - ythanks for the replies. A bit confused though and could realy use some help. I have read some threads but here are my remaining questions:

1. "We suggest using the interest calculation spreadsheets, and removing the interest column (if its not for contractual interest) before printing to send." I don't understand what is meant by this. Why should i remove the interest column and how will the interest be worked out then?

2. Should I even be claiming contractual interest (sorry I have no idea...)

3. I am using the England - Simple - Excel spereadsheet - I think this is ok.

Thanks!!!!!!!

It means, use a spreadsheet, like the one you've linked to below. Whilst sending your first 2 letters (prelim and LBA)_ do not put the interest column on it, only the "in respect of", "the Amount" and the "date" columns.

The reason is because you can only claim the 8% interest if you issue MCOL, before then, you can't claim it.

2. Should I even be claiming contractual interest (sorry I have no idea...)

That is entirely up to you - I haven't at all, because to be honest I haven't had a chance to research it. Also, I think some companies try to not pay it, and I just want the quickest payout.....and I am not being greedy, I am happy with getting back what I've been charged and the 8% interest.

You wuld really need to reserach it more thouhg if you want to claim it....whether you claim it or not though is your decision.

3. I am using the England - Simple - Excel spereadsheet - I think this is ok.

It is, but I don't think that will help you if you want to claim for contractural interest.

There is a thread about contractural interest - I'll try to find you the link!

Good louck, and keep us posted!!

Thanks!!!!!!!

Thanks again. My understanding is that I can use the 8 % which I think is enough bither and I am not too greedy so am happy to get back my original amount and 8% is fine, so will go with the England - Simple - Excel spreadsheet.

So my next step will be to send the 1st letter with no interest column then the second wait for the MCOL and then send the 3rd with the interest. thanks guys!!
