Hello everyone

 

I have received my first response from NatWest. You guessed it. They basically told me to get lost. About to send LBA. Any help and advice would be appreciated.

I have been advised to open up another account incase the bank close my account.

 

Can anyone tell me what a parachute account is, as I went into Natwest and asked them about this and they looked at me like im an alien?

 

I am in the process of filing my court claim on line as natwest ignored my LBA.

The word Parachute doesnt mean the name of a particular type of account, it just means for you to open another account with someone other than NatWest in case they do close your account.

 

Good luck with you claim, you are at the same stage as me, im filing tomorrow so will keep an eye on your progress.

If you have entered all your details into the spreadsheet on this site then it will have calculated the 8% for you. To work out the daily rate take the total of your charges and multiply by 0.00022.

For example, if your charges come to £2000, then daily rate would be:-

 

2000 x 0.00022 = £0.44

So long as the £4,429.35 is just charges then that looks fine.

Yes, that is charges including the 8%. Is that correct? :)

 

No, you shouldn't include the 8% when working out the daily rate, I wish we could though!!

Just be aware it now that natwest try to get all bullying and scary. Dont worry about it too much as long as you follow the steps outlined on here. nearly evryone of us will have had some sort of bullying reply from Natwest/Cobblers so you wont be alone!

I have received a request for further information from Cobbetts. This is what they are requesting.

2.1 in relation to each charge please identify (a) the date when the charge was charged; (b) the amount of the same; and © the reason (s) given for the charging of the same.

2.2 in relation to each charge, please clarify the following: (a) is it the case of the Claimant the same should not have been charged? (b) if yes; please explain why the claimant contends that the same should not have been charged? © if no; is it the case of the claimant that the same should not have been charged in this amount? (d) if yes; please explain why the claimant contends that the same should not have been charged in this amount and identify the sum the claimant contends should have been charged. (e) if no; please state the claimants case.

3. in your claim you state that “[the defendant’s] charges are a disproportionate penalty and thus unenforceable as they are contrary to common law”

4. Please provide the following particulars in support of your claim:

4.1 Please specify the clause(s) pursuant to which the charges where applied;

4.2 Please specify whether the charges applied were due to a breach of contract by the claimant;

4.3 Please identify in each case the particular breach of contract (by reference to appropriate term(s) of the contract) that the charge related to.

5. in your claim you state that charges are “invalid under the unfair (contracts) Terms Act 1977 s.4 and Unfair Terms in Consumer Contracts Regulations 1999 Para.8 and Sch.2(1)(e)” and “unreasonable within the meaning of Supply of Goods and Services Act 1982 S.15”.

6. Please specify all of the facts relied on by the claimant in support of the contentions in paragraph 5 above, and in particular please identify the contractual provision(s) that the claimant alleges are invalid by reference to UCAT/the Regulations.

 

I know the first bit is the schedule of charges. What else do I have to send?

I have now prepared my cpr letter. My claim is for £4429.35 incl interest. With court fees it adds up to £4649.35. The court fees are not included in my schedule of charges. Does this matter? or do i have to include it in the letter somewhere? Do I also send the text from my particulars of claim?

The court fee's will be automatically added by the court.

 

I didn't enter the text from my POC - Just sent another copy of my Schedule of Charges

I did smile as well but to clarify, Chantelle, a parachute account is an account that you open at another bank from the one that has got charges on. So if you are with NatWest then you open an account with another bank, for example, HSBC or Lloyds TSB or other ones.

Happy New Year to everyone - just a little reminder - its not so funny when they wipe your new account credit balance out. It happened to me, I was told by CAB to open a new account which I did, I move my salary and direct debits. This account was in credit and when Natwest closed the originial account, they moved the funds to off set the debt. I was left with no money and the direct debits cancelled and unpaid. Which left me in up to the neck in it! CAB forgot to mention the new parachute had to be with another bank. I did complain to Nat West and was told 'oh so

Politely' they were within their rights. BIG DEAL I was left skint and its taken months to get back on my feet.
