Hi - This is my first post to the site - i am currently dealing with a very unhelpful HSBC who have taken £250 this month in returned dd charges - the dd's have been less than the charge!! I really need help and advice - i have tried to get a copy of my charges but they say they cant do this - only send me copy statements - is this right? where do i go now?

Hi Lucyloo

 

It would be better to get your statements in full as you can then see the full data they hold on you. Send an S.A.R (Subject Access Request ) to your bank or credit card company with a cheque for £10. You could try and call them, you may get them for free.

 

Before you start please have a thorough read of the FAQs (there’s a Step by Step guide here too). You should print both of these out to refer to, so as to avoid having to ask basic questions later. Our aim is to make you aware of your rights as a consumer, enabling you to fight back against unlawful bank, credit and store card charges. In the website you will find information on how you could get your money back

 

Then look at other threads in your bank’s forum, so as you know what you can expect to happen. You can claim back your charges, and a few are trying for the payback of Early Redemption Charges on loans and Mortgages.

 

You need to spend 2 or 3 days gradually getting your head round everything. If you find a forum/thread/post of interest, save it in your Favourites, so as you can always find it easily.

 

There’s a lot to take in, but it’s time well spent and will ensure that you succeed in your claim without problems. Remember it’s not a race, don’t rush, just follow the guidelines one step at a time.

 

Take your time and have a good read around this site. Then come and join us in our forum. Here we can guide you every step of the way. Please remember, we are here to help you help your self.

 

When you feel confident that you understand the process and the various stages involved, start a new thread in your bank’s forum and post your progress and any questions there and you’ll get plenty of help.

statements arrived this morning - and last week a letter from the bank saying "Sorry i felt it nexessary to complain" - i have been busy reading and working out my claim - i have only had the account for 2 years and total charges is only £450 - am i ready to send the letter now asking for a refund?

Lucyloo yes if you feel ready then you can begin.....but I would suggest you carry on reading more to prepare yourself for the next step.By asking this question you are showing that you are not completely briefed !!!

Letter came this morning saying they are looking into it, have been reading some other posts and the faq but confused myself. Shall i send the lba now (the 14 days has expired)?

 

I know this question may sound like i havent read through, i have but am getting flustered and want to be 100% sure before i do anything.

I would'nt be in too much of a rush to send the LBA. IF they have said they are looking into it, then by all means sent letters, faxes, make phone calls to hurry them up but let them answer your letter. It will probably say that there is no claim and their charges are justified ( mine did), but later on they will make you an offer, possibly after the LBA, which will show your not satisied with their response. A first refusal letter could give you leverage if they later make an offer. Effectively they are going against their own statments. Take more time to read through as many HSBC threads as you can from start to finish. You will find that most if not all follow the same sort of path. I am awaiting a final payment from DG solicitors and by following the step-by-step guide, its been a bit of a roller coaster ride...but it as all happened as the guide said it would. Keep copies of everything and keep refering back to previous correspondence when you write to them. This shows them that you are in control and aware of whats going on. I would'nt quote too many laws at them unless you have a full understanding yourself. Just refer to that which is mentioned in the template letters. Do not give them the oportunity to bury you in the legal stuff!

 

What ever you do, don't get flustered! Research all you can and show that you know what you want. And when in doubt.........ask!

Excellent - thank you. I will give them another 14 days to answer my letter then get ready to send the LBA. I need to get over the "oh my goodness its a big scary bank" and know that i am in the right.

Lucy, you certainly are in the right, but even if you are not it doesn't matter the banks are paying out. Just think of it as a long term savings account that you have with them at 8% interest ;)

You'll find lots of great people on this site all eager to help reclaim what is rightfully yours.

Not had any response from HSBC - more charges are being applied - i have gone over my £500 overdraft twice now by £5 and been charged £50 both times, as a result of these charges a dd was returned for £30 resulting in another £25 charge - been in today to see if i could increase my overdraft by £50 to prevent any more charges being applied and i was told no - basicly in order to increase my overdraft i need to prove i dont need it - umm forgive me for being stupid but isnt an overdraft there for when you do need it?!!!!

Also had a very nice call from the bank last week to tell me my account was within the limit however ther previous day i had been over my limit by the afore mentioned £5 and was going to be charged - the lady could not understand why i was angry with her call - i said why didnt they call yesterday and i could have put £5 in the account!! It just makes me so cross!!

Do you think i should send the LBA now as i have submitted 2 chaser letters that have prompted no response and i am almost 21 days passed

Its upto you Lucy, i had my offer this morning too. Appears yours is the standard 85% ish, whereas mine is for about 93%. Thats only because i cheeekily included charges in mine that i knew had already been refunded !! Was hoping theyd offer 85% of the total,which they did, but they didnt take the already refunded charges out first !!hence the 93% ,

 

Im probably going to accept my offer, cos to lay out another £120.00 to file, and then another £100.00 for the AQ seems silly to pursue an extra smalllish amount. Cut and run time for me........at least unless i change my mind at some point today !!

lucy, don't forget about the extra's you've added - they haven't offered for those - perhaps you could send a letter (see the rejecting letters for a template) stating you have added some charges - and if they would include those charges (right up to the 18th) you would consider accepting their offer - and give them 10 days to get back to you (that's what dg gives you when they offer!), so, get it? add the charges that weren't on the schedule - list them by date, what it's called and how much and give them a total, then give them 10 days to respond with a full offer.

and if they don't - just carry on (that's what i think i'd do).

Ok - update - the 14 days from the LBA had expired so on the 14 feb i set about and filed my claim with MCOL. The following morning an offer from HSBC can at £417 £80 less than i was asking for. Because i had already started the claim i had nothing to loose so i rejected the offer. They have now aknowledged my claim - from reading other threads i understand they may try to defend my claim - can i have some reasurance pls - should i get onto the court and ask to see their defence?

hi lucy

just keep your on the mcol status. it will change to 'defended' and then a few days later you will receive a copy of the defence with the notice of transfer proceedings (telling you which court the case will now be heard instead of mcol) and an allocation questionaire.

 

this will be a while so read as many threads as you can and look at the procedure for filling out the questionaire - i'll post a link below

Thanks netty - its getting a bit scary now - i know i am in the right and the threds on here are really helpfull but there is still that little bit of worry - the "What if its me they defend in court" and "Ohh it is a big bank and i am just a little person" But everytime i read the sucsessfull threds i reasure myself.

i know what you mean about 'the little person' taking on the 'big institutions' but hey, just think how 'big' you're going to feel when you have your money back. hang in there you're doing fine:)

Thanks guys - do you have any links to good threds with help in filling in the aq? (also what does it stand for?) positive thoughts - i'm a life coach so i should be good at positive thinking :p
