Well after lurking for a while I have taken the plunge and I have completed step 1 (asking for the statements Data Protection Act etc) and have received my reply from the Halifax saying that I should recieve my statements by the 4th of February.

 

I'll keep you updated.

You've definately taken the first step into claiming back what's rightfully yours.

 

Spend time reading the FAQ's and the Step by Step guide as this will stop you making mistakes along the way. Use the letters and spreadsheets in the Templates Library as these have all been tried and tested in successful claims. Read as many threads as you can especially ones that relate to your bank. This is a SELF HELP site and won’t do the work involved for you. However, everything you need is on here somewhere.

 

Don't be afraid to ask any questions, no matter how stupid they may seem, but please remember that any advice that you receive is normally based on experience only and that you should seek expert advice if required.

I've found it's a waiting game, they're obviously inundated with these claims at the moment and they're struggling to keep up! Before I found this site, I knew I'd been charged a lot but never thought I'd be able to get it back. Hope you recieve your full statements soon so you can calculate the amount.

You will also be shocked that each charge on the card is £30!! Ive issued and awaiting Judgment. Hope its soon need a new spring wardrobe

Received all my statements today, using the spreadsheet the various charges amount to £843 before interest, just to check before I send off my prelim can I include a £12 charge that I got in october (I'm 99% sure £12 charges are claimable too as it's still wayyyyy to high just want someone to reassure me)

I claimed an additional £12 charge in with my LBA schedule. They added it on after I sent them the prelim schedule.

Where did you send the S.A.R - (Subject Access Request) to?

I only have an address in Scotland, is there one in England?

As my claim is for charges against my Halifax Credit card I sent it to the scottish address.....

I received a letter confirming receipt of my SAR about 4 days after I sent it, the 2 weeks later a letter confirming they had sent my statements under separate cover and 3 days later my statements turned up. I am in Northern Ireland btw.

I sent my sar to halifax address for two acc's normal and cc

received a reply back from that address for 1st acc got two letters from scotland re cc did not reply to them and have now sent lba for those acc's to leeds address customer relations ..and thats where mycol will be aimed at if needed..

ps I have also read somewhere keep away from scots address so either of these 2 add is fine for me

yep, I recieved that exact same letter :)

 

next letter you get will probably be the "we regret that you have found cause for complaint.....I am examining your concerns.....a response from us within four weeks" one.

received response to my LBA today basically saying ....regret to advise I am unable to refund.....

 

I will now prepare my small claim and file it online. just to confirm 2 things -

 

1. I am in Northern Ireland - can I use the same wording as this (http://www.consumeractiongroup.co.uk/forum/bank-templates-library/34887-5-money-claim-line.html) to submit my online claim

 

2. Can someone confirm the address to which I address my claim, although this is Halifax Credit Card and so far all correspondance has been with their scotish address I think I issue the claim against the England address?

You do use the address in Halifax, West yorks. Once the claim is issued you can send it to Northampton (moneyclaim online) for them to serve. Once Defence filed it will be transferred to your home Court & you can then serve it again on the Sols who go on record for Halifax

Moneyclaim online does not work for claims in Northern Ireland. Stick to the Northern Ireland Court Service. Northern Ireland Court Service There will be a contact number on the site for you to ask about the schedule of charges.
