Hi

I have followed the guidelines on the website to claim £1674 including interest from barclays.

I have filed a claim online and Barclays are defending it. I am now terrified and not sure what to do next.

From the court I have received:

Notice of transfer of proceedings to my local court.

A letter asking for a further £100 as the claim is over £1500.

An allocation questionairre - N149 - to be completed and returned by 16th january.

Barclay's defence and counterclaim which disputes the full amount and gives their defence over 3 pages. This makes horrific reading,

Please help - I need to know what to do next. Do you think I should continue my claim?

If I get a date for court - what should I do to prepare? Are barclay's likely to turn up?

How do i ger a court Buddy and how does this work?

Help!!

Hi

I have filed a claim online and Barclays are defending it. I am now terrified and not sure what to do next.

From the court I have received:

Notice of transfer of proceedings to my local court. this is normal and nothing to worry about.

A letter asking for a further £100 as the claim is over £1500. This is prob the allocation questionnaire fee, i would think.

An allocation questionairre - N149 - to be completed and returned by 16th january. This is what the £100 is for i'm sure, and yes you have to pay this but you will get this back from them when you win.

Barclay's defence and counterclaim which disputes the full amount and gives their defence over 3 pages. This makes horrific reading,

Can you be a bit more specific about what this contains, its prob the standard defence?

Please help - I need to know what to do next. Do you think I should continue my claim? Yes, they are only trying to scare you, by fireing legal jargon at you so you feel ill-equiped, just continue to post your questions and you will get all the support you need.

If I get a date for court - what should I do to prepare? Are barclay's likely to turn up? http://www.consumeractiongroup.co.uk/forum/bank-templates-library/33060-basic-court-bundle.html see this and no they haven't yet

Just one to the Court now. They are the intermediary - unless, that is, you didn't send one to them when you initially filed at Court.

I am in the process of trying to get my charges back from barclays-allocation questionaire goes in monday-do I need to send list of charges with it. Also I notice from reading everyone elses 'stories' Barclays' offered a settlement sum(though this was always refused) in many cases. I was offered nothing-does this mean they are moer likely to turn up in court -very worried!!!!!

Yes send the schedule.Dont worry about not getting an offer yet..some get one early others later some not at all its nothing to worry about.Get the aq in sit back and wait.

Chances of you going to court are much more likely than them going ......if you get my drift !!;)

Took my allocation questionaire to my local court jan 14th. Court date set for 25th May(even though I tolg them on aq on hol at this time)

Sorting out info for court bundle-do I need to highlight all relevant parts -eg in relevant case summaries, supply of goods and services act, unfair contract terms act etc... or can I leave as they are .Reading through other peoples experiences barclays appear to be takin many people to the edge -very scary-have been tempted to give up but got this far!!!

should I be ringing barclays to try and settle or just wait ?

I left mine as they are, mazza. As long as you have a reasonable idea in your mind as to your argument should you go to court....

Got my court date 20th July -very nervous-can't get through to anyone at barclays so no settlement yet! Looks set to go all the way. Do I need to put in all bank statements or just the ones with charges on them. Is Krysta Campbell the person I need to speak to?

Just the statements with charges on will suffice. After all we can do our bit to save the environment even if Barclays don't by sending out 100's of 1000's of computer automated letters to its customers with unlawful charges on.

A court bundle is not or HAS NOT to date been submitted by B's purely because they know they will not be attending court and therefore do not need to spend the time preparing one.

Email the team stating you are aware of the missed deadline and are going you apply to get their defence struck out on the grounds of not complying with the courts directions.

then go on to mention you are wiling to settle out of court.

I don't think Barclays have ever produced a court bundle as it is never needed. You will get your offer of settlement at the very last minute.

If the letter isnt for the amount thats right then just contact Thomas explaining that you think his figures are wrong as the sum you have is £xxx ..... Dont accept anything less than you are happy with

Any typos spelling mistakes are due to leprechauns in my keyboard they move the letters around sometimes (amended just for Bookie)

Have discoverd today that b defaulted my account, they closed my account in april and i had an agreement with them to pay a certain amount each month for 6 mths them review.the cab had written to them in feb and march offering payment and requesting interest and charges be stopped at this time.barclays deny recieving such letters and added charges and interest of approx £280 at this time. I had cleared the balance on the account 2mths after agreement made.I was never served with default notice and only knew today when i ran a credit check on myself. can i request default be lifted or is it now to late

Hi

I have filed a court claim against Barclays for 2 accounts respectively of£1712.70 and £1346.04 i.e. for £3058.74. Barclays have filed a defence and the claim is proceeding shortly to the Small Claims Court. I have included compound interest into the total. I need advice from anyone who has been in a similar position and how I should proceed from here? i.e. how should I mount a defence?!!!!!! Any help would be appreciated. Many thanks, David.

For starters you don't mount a defence as you are the claimant. You as the claimant get your arguements together.
