Hiya Milly,

Glad you got your answers etc.. - I know from my own local court these people are so busy dealing with this Bank stuff I have only just heard this morning form stuff posted to court in New Year week - so it does seem to be up and down the country? Courts are just so busy?

It's a real shame that the Banks are allowed to use the court system like this in their delay tactics - rather than them simply resolving matters.

Hello elizabeth:)

I totally agree because they have paid up all roughly at the same time it seems. Wasting more money repaying us court fees etc. I am surprised the judges allow this to go on with the banks and CC companies - pure waste of the courts time.

On another subject of wasting time, my O/H sent a S.A.R to goldfish for his closed account and they have stated that he has to contact lloyds as they were taken over by Morgan Stanley in Feb 2006 and his account was not transferred. The thing is how would Llloyds hold S.A.R information about him as he was never their customer and surely his Golfish CC number would not come up on their system:confused: I think they are just wasting time.

Milly - did they give a contact name or address to go to?? - cause you could simply phone and check it out making sure the correct details have been given to you etc.. - they'd still be able to access the files at the new company etc.. - I am sure it will be a case of you double checking you got the right place to get the data from etc..

Right....naughty Capital One. O/H received a letter from Mr Udy today dated 19th Jan but postmarked 24-1-07. Me thinks they are trying to tell untruths about the fact they only really sent the letter yesterday!!!

Doesn't make any reference to what letter it is in reply to as it does not say 'in reply to your letter dated ...' he is offering a third of the charges.

This however is all too late as LBA deadline was 16th and O/H filed 17th Jan at CC. So lets presume it was backdated then they got the date wrong:D !

Decided to reply today and letter is sent rejecting offer and told them that as they had not replied by the deadline given in the LBA, so court proceedings have commenced, however O/H has given them the option to settle in full and the claim will be withdrawn.

So their stalling tactics have not paid off this time...naughty Mr Udy changing the date , though that may not be the case just my opinion:) !!!

O/H also told them they should be receiving notification from the court shortly...ha!

What game do you think they are playing?

by the way have Capital one filed adefence and has anybody ever had to reply to one??

Hi Milly, that is normal for Capital One. You have already taken a claim against them, they will pay up. My husbands claim with was settled in full today after their agreement after the MCOL was done. You are nearly there.

DS and Elizabeth I agree totally they do not like the tables being turned whatsoever,I think of Mr Udy as 'the banker' on Deal or No Deal....hee hee:D or maybe Mr Bean:D !!!

The best thing we are both looking forward to,will be clearing the card completely and having a little left over to put towards another debt.

P.s on another subject are you having probs with searches being restricted and sigs disappearing?

Milly - be nice to clear it and like you say repay something else!! :D Kind of makes it fun??

Sometimes the site does go a bit "squiffy" and doesn't let me do something - maybe just when it gets busy? I usually come out of it and then come back in again and it usually just fixes itself - could be just that I double clicked something rather than single clicked it gets confused? Just try it again a few minutes after it works for me ha ha

Milly, I do not think Mr Uddy exsist, I have said this time and time again, he never answers letters on what has been written. I suspect if you just wrote anything, you would have the same basic reply. I am sure Mr Uddy is a sudo name. Hang in there and you will be paid.

So far I found Capital One to be the best of the bunch and have paid up pretty quickly but once the claim has been made against them. In both mine and hubby's they settled as soon as they entered the defence and in full and no questions asked. So hang on in there you are reallly well on your way to winning.

Hi DS do you think it makes a difference that you used MCOL as my O/H has filed a N1 and maybe they were not aware they were giving you back contractual, whereas my O/H has stated this on the N1?
