Hello everyone. This site was recommended to me after discussing with a friend about the fact that I had mistakenly gone overdrawn on my Halifax account, the bank paid my gas and electricity direct debits then charged me £30 per direct debit for doing so and a £28 unauthorised borrowing fee! A grand total of £88 in one day! Is this allowed? I have been browsing this site for the last two hours but am a little unsure of my first move.

Is this the only time you have been charged?

No it isn't allowed as it is unlawful, if as stansfield said this is your first charge then ring and ask for it back, if you don't get it back then start the process detailed on this site.

If this IS the only time you have been charged, then you do not need to do the SAR. Just send them a letter with the dates of the charges and amounts on asking for it back. If you get fob off letter, do your Letter Before Action and then onto MCOL. However, if you think there are other charges in the past, then do the SAR. Hope this helps.

Well they think its allowed..........actually they quote that they can take a maximum of 3 charges per day.

Obviously the overdraw causes the unauthorised OD fee to then kick in........they say that you have to pay this if the overdraw is more than 28 quid or something like this.......but by virtue of their charges being more than this it automatically kicks in and of course as we know creates the domino effect.

As suggested if there has been previous charges then if you have statements work them all out.

If not then send for them.
