      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have proved totally that LLoyds Collections Centre lies and will do what ever they can to keep you in the dark.

 

by

 

with holding employees names when you wish to make a complaint.

The reason " there is no way of identifying the person who took your call"

 

and also by advising

 

"There are no records from the conversation you held with this person".

 

LLoyds collections run by thier own rules.

 

Today I have been given the employees identification number and the notes made regarding the conversation in question. Basically all of the information that didn't exist.

 

 

How do they get away with it.

can i nudge this up as im sure lloyds is going to tell me the conversations where not recorded.

 

can anyone confirm that they all are or some are?

 

all the calls i want are to the collections department.

The main recording I want was actually made by me form a branch telephone to the collections centre.

 

Im hoping I have enough evidence in these recordings to make Lloyds disapear from my life pronto and the problem is they know this to.

 

any ideals?

Was your DPA receipt just a bunch of bank statements? I believe this is supposed to be a complete record of all phone calls, letters and any other information they hold on you. I received a response to a DPA request from Three and it listed all calls and notes of the conversations.

 

I'm not sure they are recorded, or just that they "may be recorded for training purposes". Hope this helps.

The DPA customer notes etc, never covered the collection centre side of things, its like the collection centre is its own entity.

 

So i have resent the Collections DPA and advised to take the cost of £10 form my account but for it be known that i have already paid Lloyds £10 for my active account information.

 

I have also sent a request for teh recordings with the Data release sentence in it, no ideal if it will work. Also advised i would accept a £10 charge for teh recordings as if they have them im home and dry.

 

will let you know how it goes.

I modified my DPDR and asked for all recordings of telephone conversations and in particular one that I gave a date time and the person spoken to.

 

After 37 days I recieved just copy statements and notes, no mention of telephone calls. I think an email to Ms Berryman might be in order to check whether they have complied fully with my DPDR and warning her of the consequences if they haven't.

A few years ago I made a compalint to HSBC about a staff member in a call centre.

 

They went away and listened to the recording and came back and upheld my compalint (sort of)

 

So I know that HSBC keep a log somewhere, but proving it and getting it released to you, may be harder!

Last year I made a complaint to HSBC. When they failed to resolve an agreement that had been made I insisted they listen to the recording of our telephone conversation. A week or so later, without admitting anything they refunded the fees that I was disputing.

Thats brilliant, is there nothing you guys don't cover.

 

The Main Convo im trying to get was held from a branch phone to the collections centre.

 

I can tape it with a hand recorder, but once i advise i am doing this i dont think they will lie again.

Im desperate ( but dont tell LLoyds lol) to get my hands on this 1 call.
