    • Hello, Following the submission of my defense, last night I received an email from DCBL indicating that the claimant intends to proceed with the claim (I've attached a screenshot of the email for reference) along with the N180 directions questionnaire. I'm unsure how they obtained my email, but I suspect it was through the courts' form when I completed the Acknowledgment of Service. This email almost slipped my attention. I have also today received a letter from court to state they have received my defense.  It appears they are requesting an online telephone hearing with the court.     • Default Amount £9237.88, all this started in 2006 Admitted debt £9075.65 Weightmans added £1515.01 immediately they became involved, no explanation The Statement shows when Marlin bought debt in May 2011 £10439.25 Their statements, not received until the SAR, are based on this. Cabot deducted £1515.01on their statements in January 2019, again did not find this out until SAR. Weightmans added in  2007 after the CH1 etc was confirmed by the court £741.50, made up of Process server fees, Court Fee (they tried for bankruptcy), Solicitors fee and Land Registry fee. Unspecfied Legal costs were added by Marlin in March 2015, again I did not know this until statements received with SAR I had been paying monthly, without exception until December 2018. I am minded to take the property charge, CH1 amount ,deduct all my payments and the subsequent fees, and request/demand a refund on the final payment made? I consistently disputed Weightmans balances, but they never responded. I also told Mortimer Clarke/Cabot that I disputed their amounts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My boyf and i have done the DPA, Prelim and LBA letters our joint account and solo accounts.

 

We are now up to the stage where we submit a claim with the courts...

 

My boys has just got a letter today saying they will pay £750. "We are making this offer as a gesture of goodwill because we might face that cost in dealing with your complaint if you took it any further"

 

He has just looked into his online banking and checked the balance. Lloydstsb have dropped £750 biggrin.gif Sweet! (Needless to say, we are still pursuing the rest, so will probably need some assistance in explaining how the interest bits will work on all this, but I can save that til I get all bits off the computer at work)

 

Has any body else had this happen from LTSB? Im crossing my fingers and hopig I will get a similar interim payment from them too in the next few days!!!

This seems to be Lloyds' approach with the newer claims now. From what I've seen people are being advised to either reject the offer and carry on as normal for the entire amount, or if they are going to accept it then they must let the bank know that this is as partial payment only.

 

There are quite a few cases of this happening lately and I think I've seen a couple of posts on it today, which should be on the first page of this forum somewhere.

Hi everyone,

 

I have just received a similar letter yesterday offering me £750 and I find that Lloyds have actually put the money into my account,

 

Do we still take Lloyds to court through Moneyclaim online or send another letter ? I had sent my 14 days letter at the beginning of December.

send the Rejection of settlement offer letter and proceed with your claim as per your original deadlines.

It seems my boyf isnt the only one judging by several peoples accounts from here, that are recieving this £750 goodwill gesture...

 

As i mentioned above though, how come they havnt offered my solo account or our joint account a £750 rebate, even though we sent off the letters near enough the same times?

Is it just random people?

Does anyone understand what the circumstances are to have recieved a rebate?

Are they doing it alphabetically (my boyfs surname ends in A, mine ends in P...)

hi there. well done on getting this far. i had excatly the same thing. i got a letter on thursday giving me £750 as a goodwill gesture, and it was in my account the next day, and ive now sent a letter to them saying that i will accept this as a partial payment only and in a week i will begin court proceedings.

Is the first letter of your surname between A and P perchance. I just want to know why I havnt got a refund and my boyf has and if theyre doing it to random people or everyone in turn.

 

Plus our joint account is under £750. perhaps thats why they havnt refunded it?

Well, its £580 now with the joint account, £1800 with the boyfs, and anout £2450 odd with mine, i think if we add all the interest in it comes to £5500 plus... (minus the £750 my boyf recieved. I was going to file my mcol tonight for the joint account, but all my info is at work and pn the PC at work!

 

Do you know how to do an mcol for the joint account? Can you put "Mr AXXX and Miss PXXX" in the surname and "CXXX and PXXX" in the forenames or do i have to just do one name or not bother with mcol and do a handwritten one?

Hmmm!!! Praps i could be looking forward to refund in a few weeks then as P is quite a few letters away from A and D! Just a theory, but thanks!

 

 

Id be interested to see if anyone else who has had thier refunds are at the early end of the alphabet, then the theory of refunding people alphabetically could be right...!

I received £750 from Lloyds just before Christmas and my surname begins with T so I don't think your theory is quite right. It may be that names are picked at random or from the date the claim was first made. In my case I sent my prelim asking for £5952.00. in November 2006. I don't think that it is the value of the claim because there are posts on here where £750 has been refunded where the total value of the claim is only slightly higher.

i had the same just before Xmas. they did not ask for any conditions so i didn't bother to write back. in fact, i had already summonsed them, by then. they cannot unilaterally impose a settlement and i did say that i required full repayment and that the LBA was my final communication. however, i won't object if they adjust the balance of my claim.

i recieved a letter from lloyds tsb on saturday which stated a £750 GOODWILL GESTURED would be in my accont in the next few days .is it ok to use this moneyand still proceed with court action .i am worried incase there might assume that it is a settlement offer and by me spending it it would stop me from going futher to recover the full amount £6000 +

Send the Rejection of settlement offer letter and proceed with your claim as per your original deadlines.

 

Also, please do start your own thread. You'll then have your very own timeline which you can update as your claim progresses, and where people will be able to offer you help as and when you need it.

Congrats on getting at least some of your payment through.

 

I sent my prelim just before Christmas, their time is up now but I have not been back home in a few days so do not know if they have written to me yet. I do know that they have not credited my account though :( I keep checking just to make sure.

Does anyone know if they try and pull any retaliatory action like closing account or pulling OD?

 

My bf can claim but is worried they could pull his OD which is way more than his total charges. Is it worth waiting until this is paid off before claiming?

from what i understand though, you make it clear that you want the refund on your terms, so if you want to pay it off you can, but if you want a big fat cheque, its not up to them to decide you can't have it.
