      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys

I got caught with my mum's freedom pass the other day.

I have now received a letter asking how I'm going to plea

I've only just received it but it says reply within 10 days of the letter from when it was dated on the 17th june which seems unfair, but anyway!

What's my best bet here?

I have seen the best thing and it's the most logical, is to just come clean, say say it was wrong and plead with them!

I've attached the letters they have sent

I used it just one time and one time only.

I have proof of using my bank card and a couple of different oyster cards of mine and also, upto the end of may I had a travelcard so I can prove that ive been paying the rest of the time 

Here is my letter.... If it's any good I'm not sure 

I am writing to offer my sincerest apologies for the recent misuse of my mother's Freedom Pass on the 15th June 2024. I fully understand that this pass is a valuable benefit provided to eligible individuals and that its use by anyone other than the designated person is strictly prohibited.


This doesn't excuse me from any wrongdoing, but just to explain the  that this was merely a single use of the pass, and I felt guilty at the time of being stopped so I just handed it over as for as long as I can remember I've paid for my travel and I can forward any evidence of this if need be.

On the day I had had breakfast with my mum and then left for work and then, when touching in at the barriers my Google pay hadn't work for some reason still not known to me and with no shops nearby in the area that I could top up an oyster card I had, using Google pay, I felt that I had no other choice but to go back and use my mums pass.

My mum's pass was on her table and I picked it up and decided to use it without her knowledge while she was taking her morning shower 

In saying all this however, my actions were inexcusable, and I deeply regret any inconvenience and potential financial loss caused to Transport for London. I now fully appreciate the importance of adhering to the rules and regulations surrounding the use of Freedom Passes and public transport services after reading up on the losses made due to freedom pass misuse and general dare evasion.

Please be assured that this incident has been a significant learning experience for me. I am committed to ensuring that such a lapse in judgment will never occur again. I am more than willing to cooperate with any necessary steps that may be required as a result of my actions and I am even willing to offer my own time to help make up for my actions in one way or another, if possible.

Once again, I offer my deepest apologies for this mistake. I hope that you can consider my apology and allow me the opportunity to rectify the situation.

Hi.

You've left the case number showing in your pdf. I would remove that.

I think your letter isn't a bad first draft, although I think it can be refined.

In the paragraph about why you used the Freedom pass, you say you had no choice about using it. You didn't have another means of payment or way to top up the Oyster card? Bear in mind that it seems to be rare for people to be caught on the first use of a card like this and TfL will know this.

If it were my letter, I would add to the 'Please be assured..' paragraph to say how you will make sure you follow the rules in future. A bland assurance doesn't really tell them anything.

Are you planning to reply by email as it's due with them tomorrow?

Ok thanks for the advice I'll make that edit 

I know it is rare and I would be happy for them to check and they'll see I've never used it previously I just wanted to make that clear without sounding like it's ok just to use it once a it's not.

The letter was dated on the 17th so I'll have to send it today by email.

Is there anything else you would recommend changing?

Should I remove my reason for using it do you think?

just type no need to hit quote.

it's only one use, though it was purposefully taken, you might not just get a warning letter. 

but typically one use offences get a warning letter or an OOC easily.

i wouldn't panic about meeting the time limit, a few days late against getting your begging letter correct is very worth it.

But if I email them late then they'll proceed without my plea, no?

One thing I will write is that I have activated auto top up now on my oyster card that I use so that I don't have a situation in which I dont have money on my card 

Also should I provide evidence of me using my oyster and back card at all?

Hopefully I can get a statement of some sort

does not work like that , IF IF IF they want to goto court that will be MONTHS away if ever.

get your letter good... thats a far better way to use the time.

past proof of use or payment is the past......

it's why you thought it was ok to just take her card and use it without any thought toward the law that is your main stumbling point here and needs to be addressed.

I firstly want to thank TFL for allowing me to explain myself and my thoughts on my actions.

I appreciate the seriousness of the offence and how wrong it was, and I am deeply sorry for my actions.

In this letter, I hope to explain how me being prosecuted would leave my work situation in jeopardy, and also my families lives in a difficult situation.

My actions were inexcusable.

I am fully aware that TFL wouldn't exist as a company if people did not pay their fares and did what I did on the 15th of June. I have been completely ashamed of myself ever since this action I did. This is not only breaking the trust of my mother, but more importantly of Transport for London, the local council and the general public.

I am ashamed and I haven't slept properly in the past 12 days worrying about what I've done and I've asked myself why I would do something so silly.

I have felt so embarrassed at work, working for a company that helps people's mental and physical wellbeing being and by doing what I've done can revert me back into a vulnerable mental state which took me years to overcome.

My job requires me to have a clean criminal record, as, I am working closely with vulnerable people and I was so proud of getting a job, in which, I can help others and by doing something so silly I could potentially have thrown it all away.

At the time I was stopped, I felt so embarrassed and ashamed, I came clean instantly and handed over the freedom pass to revenue protection and apologised profusely.

I am not a law breaker and have a clean DBS (recent DBS check by Nuffield health screenshot attached via a yearly screening process that's conducted)

I ensure that I will never be a threat or a burden to the general public. I always do my best to help everyone and unfortunately on this occasion I've not helped myself by any means.

I have purchased a monthly travelcard which for years now I've been doing but recently I didn't get round to it and have learned that paying as I go is not great as I don't always leave myself alot of time to spare when travelling to work or college ( proof of my purchases have been attached to this email)

However, let me be clear that this is not an excuse, but I do hope that this proves that this is a one off and not something that I've done more than once.

One picky point, I don't call this letter a plea, to me that's something you send to a court to tell them if you plead innocent or guilty. This is just a letter.

If you're absolutely sure they won't find anything in the card's history that looks like you doing the same journey as the one you were pulled up for, then maybe it's worth showing your ticket history.

See what dx thinks, I think I prefer the first letter that you did, it seemed more concise. To be honest, TfL aren't really interested in a sob story about your job being affected. It sort of begs the question that if it's that important to you, you wouldn't want to do anything to jeopardise it.

Your letter needs to be a maximum of one side of A4 in normal size print.

You are right it's not a plea 

In my opinion now I believe the second one is better but what do I know, you guys know alot more than me!

I can't really combine the two, so maybe something between a sob story and an excuse maybe but I can't really think how to do that!

i would not keep repeating the issues this incident has upon your future , state it once and once only.

i would also not repeat several times your remorse at doing this.

state it at the start,

then state what you are doing/have now done, with proof, to prevent you from being tempted to do it again.

then your future employment etc

then your wish for an OOC/warning letter offering full payment etc 

then repeat your remorse.

your letter is far too long and repetitive IMHO.

How long is the letter now? If it runs to over one side of A4, you risk losing the attention of whoever reads it. Also remember that the tone is important; try not to sound as if you're telling TfL what to do. You're asking them nicely if they will settle out of court.

On the day of the 15th, I went to my mum's to do a few jobs for her in the morning, while she was away on holiday. I left for work and then, when touching in at the barriers my Google pay didn't work for some reason, which I'm still not sure why and also my oyster card had too little money. I went to nearby shops in Belsize Park and noone would allow me to top-up my oyster card that I also carry around and one could have but only with cash. Due to this, I felt that I had no other choice but to go back and use my mums pass as she had left it at home while she's away on holiday. My mum's pass was on her table and I picked it up and decided to use it without her knowledge.
