Hi All,

Would I still be permitted to request a copy of an agreement that has now ended? Got a bit of a dispute going on with one of the banks (haven't we all!) ;) I've SAR'd them and CCA'd them, still not come up with the goods. Main reason for this is request to get default removed from credit file, which I think might carry more weight if the bank can't prove the debt ever existed, what do you think?

Cheers,

Lee

PS. I have read the CCA 1974 top to bottom but only refers to agreements that are running.

They are no longer obliged to supply a copy of credit agreement under CCA. Even if they were this is not a way of proving existence of the agreement since they are not obliged to supply a copy of the original signed agreement in any event. A SAR should turn out all the info they hold on you which may include a copy of the original agreement if they still have it.

How long ago did you do your SAR?

Hi Zootscoot,

SAR'd in October this year. No credit ageement included in their response, or call notes either. It's not too much of a problem, just curious more than anything. Because as the account is settled I'll seek the default removal as others have done on the forum.

Cheers,

Lee
