    • Hi, I have found this group very helpful hence I am here seeking help and advice.   I got myself into a situation where I have now more than £50k in unsecured debts (personal loans & credit cards) and things are now getting out of control as I am struggling to make payments. This is purely my own created situation and I am taking 100% responsibility for it. I am keen to get out of this situation as soon as possible hence I would appreciate any help and advice in this process. I am employed at the moment and don’t want to risk going into IVA or bankruptcy as this would risk losing my job. Being sole bread earner of my family, I cannot afford to lose my job. I have been trying to keep up with the payments so far and had few missed payments instances until 3/4 months ago but got caught up with missed payments somehow using my savings. All my debts are still with original lenders. However I know I am getting into same situation again shortly and won’t be able to get out of it again. I have started exploring Debt Management Plan (DMP) option through StepChange but haven’t submitted it yet. Based on budgeting, I have around £820 available to make payments to all lenders after taking care of all other essential expenses. This is definitely lot more affordable than what I am currently paying to different lenders. 1. Is DMP right option for me in current situation? 2. what are the negative consequences of availing DMP? 3. is there something else that I can do to get out of this situation? I’m determined to clear out all my debts but need bit of breathing space and time. Let me know please if you need any additional information. Thanks in advance for all your help and guidance. MM

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ive bought a second hand Samsung phone from a Market Stall Phone seller on an indoor market for £140.

The phone works well but the problem is there's debris in the camera lens, as i live 20 miles away i asked for a refund as its a long way to travel incase a replacement went wrong too, but they refused a refund and said they only replace.

They said they would come to me and bring the replacement phone but that was 2 days ago and ive not heard anything, ill have to do the 40 mile round trip and go to them.

As they're a market trader surely they do have to refund ?

as the phone is not fit for purpose under your consumer rights and you are within 30 days? they have no legal alternate but to refund fully, unless you want to accept a replacement/refund.?

you need to formally write and exercise your right if you have not already done so.

Exercise My right ?

Put in a letter.my intentions if a refund isn't given .?

I don't have a name for them individually i just have the name they go under in the indoor market

can i just address it to that ? 

Do i have to post it recorded delivery or can i just hand it to them perhaps video it ?

Hes just messaged me and i said i want a refund which declined to give and then i said id give him a letter of interest and id take him to court and he said thats fine ican go for it ....

under your consumer rights you have a right to reject the goods as not fit for purpose within 30 days for a full refund 

they must be a licenced trader so look them up on companies house or the FCA register 

when did you purchase it please?

I purchased it on Tuesday.morning around 9.30 am, it worked perfectly untill I tried to take a.picture late afternoon when I realized that there is debris inside the lens which comes out on the picture.

I message the lad saying I'd like a refund ,

the lad apologised but said he doesn't give refunds he just exchanges and he said he'd bring one out to me which I agreed. 

  But after mulling it over I thought I wanted a refund as it's too far to go if the replacement goes wrong but he rejected the refund again and then I explained I'll go up tomorrow and ask for a refund and if he rejects again I'll give him a letter of intent to which hole replied, "Bring it on" .

After 25 minutes he messages again saying he'd bring a replacement which I declined and said Id like a refund and there's been no contact since.

They have a stall on an indoor market in the Potteries shopping centre Stoke on Trent and I've looked on Company House and I can not find Techzone Mobiles, what does that mean that they shouldn't be trading ?

On companies house the nearest thing to the people I bought the phone of is Techzone Buxton Ltd which is registered in Buxton not far from Stoke and their nature of business was retail sales of mobile phones but that was dissolved in 2022.

Edit:  Yes I think it is the same as the last name is the same of the people on company House and the person I've been messaging are the same ,  I've been messaging the Son of the owner ...

simply tell him he can NOT under the consumer rights act 2015 refuse to give a refund if under 30 days should the item be unfit for purpose.

threaten him with court if you wish, by sending a letter of claim, but you must be prepared to follow it through on day 15.

Typically he's just replied with that he's offering a replacemt but not a refund, he says he even has a sign saying No Refunds on the stall which I didn't see because I wasn't looking around the stall I was looking down at the phones in the glass counter.

I told him that it's the law to give refunds and that's why I have a case and the reply was "good luck with it "

I paid cash for the phone .

I'm happy to send a letter of claim and go to small claims if I'm certain to win ?.

It's a perminant one,  the "stall" holders in the market are actually trading from 'Units' and this chap is Unit number 10

Samsung A71 Mobile Phone £140

Purchase date 29. 5. 24

I the claimant purchased a 2nd hand Samsung A71 mobile from Techzone Mobile Phone unit 10 of the indoor market at the Potteries shopping centre.

Initially the phone worked well until I used the camera and found debris in the camera lens spoiling pictures making it not fit for purpose. I contacted the seller who offered a replacement which I initially accepted but later rejected and wanted a refund in full which the seller refused saying they Do Not give refund is unlawful and goes against the Consumer rights act 2015.

Therefore I intend to issue proceedings against you in a county court without further notice unless you reimburse me the above amount in Full within 7 days from the date of this Letter

 I think its best if i hand him the letter as posting it might not get through so can claim expenses traveling up there ?   or would it be best to just post and get 'Signed for'  ?

  Should i also put in the letter of claim interest added or leave that till the Particulars letter ?

I just worried that it being a market, the letter wont get to them , 

i have emailed the market management to complain about the No Refund sign and point out it goes against consumer rights and how they are allowing it to be displayed 

when they reply ill ask them whether Its safe to post the letter ...

I have read some court claims and im already registered with MCOL

nothing to do with the management co.

give it by hand then but that involves costs you cant reclaim.

why not simply ask the management co for the registered address for the trader and sent it there

if you know the current owner of the business the name them in addition to their trading name on the mcol form, when/if you file a claim?

Ive had a reply from the Market Manager who i emailed regarding "The Sign" in the unit that Techzone phone said they had,  they told me via Facebook Messenger that their sign says No Refunds , however, the market manager has visited the unit and the sign actually says

**** Refund Policy, We are always happy to exchange or issue a credit note for any product that is unsuitable in its original condition and with proof of purchase within 28 days. If a product is faulty we will be happy to exchange or refund it. Your statutory rights are not affected” ***

Now i never saw the sign i only know about it when Techzone mentioned it in a reply and the Market Manager says its not illegal.

If they dont abide by their sign should Trading Standards be told ?
