    • old and new threads merged i though you were going to send the SB letter in 2017? dx
    • dunno you've not scanned up what you've had before how can we tell?
    • Today , after a lot of years i received a letter from this lot. Very friendly, "Were writing to remind you that we haven't had any contact from you in a while".  The velvet fist, followed by  a veiled threat to get their preferred debt collectors involved. Yep dead right. In 1992/3 I took out a Student load under duress from DHSS. up to 2000 I had successfully gotten deferment on low income. But rather than sign on as unemployed ,I decided to be self employed. I applied and they asked for all sorts of documents. I obliged and then correspondence ceased from them, circa 2001. To date I have had no correspondence from Student Loans. I was made redundant in 2009 and reached 65 in 2012 , at which age the loan should have been cancelled. Now , today, 12 years on retirement and 11 ( at least years after last contact) I get a letter with veiled threats. Do I , as I smell a scam a) ignore it and hope that Erudio will think that this phishing attempt has failed or b) respond with a statute barred letter or c) remind them of legal terms that loan should be cancelled 12 years ago or d) combination of b) +c)
    • But I'm not mixing and matching. Sure, when researching I do check multiple avenues, but when speaking, I will open a single post. The Fb post was made in March, it is now June, time has passed, and when the suggestion was made, no further information was given on how I should progress beyond "send a letter", which has meant that I've needed to start another stream - this one, but only after taking the time to research first.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

MET CCTV PCN - Occupants Left Carpark - Appealed - Starbucks (closed) 346 SouthGate Park, Stansted, CM24 1PY

Recommended Posts

Hi All

Help or advice needed please.

I just received a parking charge for Southgate Park.

I did not receive the original charge.

Therefore I am out of the 28 days to appeal.

now I have to pay the £100.

I called them to let them know that I had paid the airport charge, the lady told me to put it in writing.

as I was sending them a email, I googled them, then I realised that it was for Macdonald's, Starbucks.

I parked at Starbucks, as they were closed I walked over to Macdonald's etc.

I haven't seen this site, I have just emailed them, telling them that I was the driver and what I did.

Am I screwed and do I now just need to pay the charge and put in down to experiences. or can I just ignore the letters ?

With much gratitude in advance

CB

We have about 130 cases at this scam site.  Yes, that's what it is.  It's been exposed as a scam site in the national press and on national television.

Of those 130 cases, in only six have MET tried court.

One was thrown out at a preliminary stage by a judge, in two cases MET discontinued when the Cagger defended, two are ongoing, and in only one case did MET actually win when the motorist stupidly didn't defend so MET won by default.

So don't pay them a penny.

Mind you, you haven't helped yourself by outing the driver when there was absolutely no need to.

No you don't have to pay them.

it is their scam which the Courts know about.

There was a classic case a few years ago that decided that £100 was not a penalty because that company had a legitimate interest in keeping the car park clear of cars that overstayed etc because they were there to maximise the availability of car park spaces.

As Starbucks was closed in your case, Met have no legitimate interest so their £100 charge IS a penalty.

Therefore the case would be thrown out.

if they took you to Court and you turned up in Court to defend yourself.

So no you shouldn't pay.

The incident was 03rd March 2024 - and that was the only letter that I have received from MET 15th April 2024

The charge I paid was at the Stansted Airport exit gate (No real relevance now - I thought this charge was for that!!).

Here is the content of email to them (Yes I know I said I was the driver !!!!) as said above

-  I thought this charge was for that!! "Stansted Airport"

Dear “To whom it may concern”

My name is ??
PCN:  ??
Veh Reg:

Date of Incident: 03rd March 2024

I have just received a parking charge final reminder letter, dated 10th April 2024 - for an overstay.

This is the first to my knowledge of any overstay.

I am aware that I am out of the 28 days, I don’t mean to be rude, this feels like it is a scam

My movements on this day in question are, I pulled into what looked like a service station on my way to pick my daughter and family up from Stansted airport.

The reason for me pulling into this area was to use a toilet, so I found Starbucks, and when into there, after the above, I then purchased a coffee. After which I then continued with my journey to pick my daughter up. (however after I sent this email I remember that Starbucks was closed so I then I walked over to Macdonalds)
There was no signs about parking or any tickets machines to explains about the parking rules.

Once at Stansted, I entered and then paid on exit.

So Im not show where I overstayed my welcome..

With gratitude

You need to send Met an SAR and they will send you the original PCN .. However all their PCNs appear to be the same and as the car parks are on airport land the keeper is not liable for the debt. Only the driver is responsible. But there are other considerations which can be enough for you to win.

Poorly lit signage; scam site, it's a penalty; as well as problems with the contract. So you have a lot of things going for you as well as Met are not keen to take well defended cases to Court.

OK, you made a bad mistake by outing yourself as the driver.

But that's not fatal.  It's a case of one argument unfortunately down, but lots of other arguments still standing.  Chiefly that this is a scam site with an invisible line separating two car parks in order to entrap motorists.

1.  As LFI says, send a SAR to MET so you can get your hands on their original invoice.  Invest in a 2nd class stamp and get a free Certificate of Posting from the post office.

2.  About six months ago, when the tsunami of cases at this site started, lots of Caggers contacted the CEO of Starbucks  https://www.ceoemail.com/s.php?id=ceo-82463&c=Starbucks UK-General Manager  Starbucks then contacted EuroGarages which seems to be another company in their group, and which runs the Stansted branch, and which got the invoice withdrawn.  However, after one, two, 10, 20 of these cases Starbucks seemed to get fed up.  However, it's only an e-mail, and surely worth a shot.  Lay it on thick about being a regular Starbucks customer but on this occasion you found the branch closed, and it is completely unfair to be charged £100 for briefly stopping in a car park while trying to use Starbucks.

The main point here though is that MET are very, very wary of starting court cases for this site.  If they don't do court there's no reason to pay them.

We could do with some help from you.
