TOTAL CONFUSION

 

The 40 days ( and a week) period is now over and i still haven't receive some of my statements. 10 months are missing in total. I've reported it to the information commissioner 2 days ago. What should I do next??

Start my court claim with the charges i can proove? or start it with an estimation?? or start a different court claim to force them to give me the missing statements before taking abbey to court to recover my money??? :confused: :confused: :confused:

I would estimate the charges. If you then receive tthe information you can alter your claim if not you will get the estimated.

:) THANKS.How do I estimate the charges for the missing statements???? Let me explain I've got my past 6 years statements and charges but 12 months of statements are missing. They are not all from the same year some in 2002, some in 2005 and others in 2001. I can remember that on two occasions I was charged arount £400 in a month in 2005.

How do I calculate an estimation for the 12 months missing???:confused:

Add up all the charges you have over the 6 years. Divide that figure by the number of months you actually have the statements for - this will give you your average. Use this average to fill in the missing months. I would do this and hope that it evens out the 2 months where £400 was taken. If it does go to court you can show how your estimated charges were calculated. HTH

I've done the calculation and the amount of the estimated charges ia lot les than the real amount I remember:( The the estimated amount is £260 an like I said I remember being charged a lot more than that ( 2 or 3 time that amount) .:( That's why abbey won't give me my statements. What should I do?? :confused:

one more problem:evil:

Abbey finally sent me the missing statements ( 11 in total) 1 month only is now missing but I can remember being charged quite a lot of money and the charges don't appear on the statements:evil: I am sure that they have been erased by Abbey as they were quite a lot and were very high:evil: .

Has anyone had the same problem before? How can I now proove that I remember past charges that don't appear on my statement?? I know the statement are incomplete but how can i proove it?:confused:

Any template letter is welcome.

In my local court they issued the claim within a few days and it was deemed served a further 2 days after that. You will get a letter showing you this from the court.

Handed mine into court in the morning 10th Jan - Claim issued same day and posted first class on the 11th Jan - deemed served on 13th Jan. Defendant had untill 29th Jan to reply (they did saying they will defend)

 

I got a 'Notice of Issue' out lining the above around the 13th Jan

Hi everyone:) I've just receive a notice of issue from my local county court. It is written that Abbey has until middle march to reply.A bit confusing:-| Do I have to fill in the request for judgment section now??Part A,,B, C,D and E? what is this all about?:-|

:) hi just one more question: my december 2005 statement is still missing. Abbey won't send it to me because £400 were taken from me in december 2005. Can I use the onlinemoneyclaim website to force compliance or is this site only to claim money?

well first becoz i have already sent my claim to court without december charges, second, i was adviced not to (

You will find it hard to claim back without the proof, you need the statement so you have two choices as i see it.

1/ file at court for other charges you have. Then when it comes in you could start a 2nd claim.

2/ Phone them and ask when they expect to have them sent advising them that you are in the process of complaining for non-compliance.))

????

Third an estimation did not reflect the real amount of charges taken.

So ur saying I should not ise MCOL for that but my local county court?

???? Nothing wrong with phoning them i asked for mine 6 times over the phone plus 4 letters eventually when i rung them i explained that the claim was at AQ stage so I needed the info two days later i got it.

Yes you'll have to use the county court for that however if you let the defendant and the courts know that part of your claim is estimated and that you reserve the right to amend the about you are claiming once you have the info from the defendant then it should be OK.
