Well,

 

Cap 1 won

Halifax won

Barclays - waiting for court date

Egg - waiting for statements

 

so I decided to move on to my husbands accounts!

 

After receiving his statements I went through them (all the time he said "it won't be more than a couple of hundred quid") ......£1705 worth of charges later I put down my (now nearly running out!!) highlighter!! :o

 

So prelim will go in the post on the 2nd Jan!!

Go girl - make sure he buys you a decent prezzie when you get his charges back!!! (suggest something costing the difference between a "couple of hundred quid" and what you finally recover )

Am still waiting for a court date for my barclays!!

Received a letter saying they think the charges are fair.

 

But no offer like I had at this stage - is this normal now?

 

LBA already sent.

MCOL completed on line on Wednesday for 2148.90

 

Feel much more confident because I won my claim in full - hurray

Barclays have until today to respond.

 

MCOL hasn't changed yet - what should I do next? I assume they'll do it at the last minute? xx

That's cos there's so many people asking, and not enough of us answering.

 

But in Barclay's case, they are so routinely one-tracked these days that all you have to do is read a few settled cases and you can follow things step-by-step, just about....

 

They acknowldge, last minute, they'll put in a defence, last minute, and sometimes late, etc, etc... The only problem is that we can't however, ever get complacent and let our guard down, because that's when they'll finally change tacks...

I agree with Bookworm, there are lots of newbies coming on and missing vital stages out assuming they can use the fast track [sorry no pun intended].

 

As soon as B's recognise this cases will start getting thrown out.

 

question bookie, if a case is thrown out, can it be restarted again?

or are the defendants protected against second attempts?

I'm not a newbie as such. I have won 3 cases in full - including my own against barclays, i was just enquiring what would happen if barclays did not acknowledge my claim as I had never been in that situation before. I wasn't trying to use the fast track

Letter from Stockport County Court today

 

Upon the Courts own motion. The Court has made this order of its own initiative without a hearing. If you object to the order, you must make an application to have it set aside.

 

IT IS ORDERED THAT

 

The action be stayed until the 3rd July 2007 for settlement by mediation/negotiation or for narrowing of issues.

 

Within 7 days of the end of the period of stay - the parties shall jointly notify the court in writing of the outcome of the negotiations and what, if any, directions are required. Failure to comply with this direction or properly engage in negotiations may result in the application of sanctions.

 

 

 

WHAT SHALL I DO?

Contact Barclays Litigation informing them that you have been directed by the judge to enter into negotiations in an attempt to resolve the issue before 3 july.

They will either agree to settle there and then or ask you to call back just before that date.

 

Keep a record of the communications.
