Caroline Vs HSBC - MCOL Help..?

Hi All,

 

I was just wondering if anyone could give me a quick brief on what happens once the 28 days allowed after the claim has been filed?

I'm guessing I don't write to anyone else so do I press the "Start Judgement" part on my page? If so what happens once I press that, I guess I go for the top option, something like "The Defendant has not submitted their defence" or whatever it says but do I have to do anything after that and what does it actually do?

I already rejected an offer a couple of weeks agofor £780, my total being claimed now, plus interest and court fees is nearer £1200

The 28 days were up on Boxing Day, 26th so I'll give it til say, Thursday or Friday til I do anything.

If someone could just let me know what to expect it would me really appreciated.

Leave it a few days?

Nah... go fo judgement now.

Leave it for a day or so, then go for baliffs!

Dont make a big fuss regarding judgement.... if you do hsbc will just apply for a stay, at least this way you get lots of baliff fun!

Of course.

 

You click for judgement just as soon as you are able. If you then proceed to make a big fuss, ie ringing up DG and hassling them they will apply for and most likely get a stay. If however, you then quietly send in the baliffs, they will have to deal with that issue too. They are still likely to get a stay, but now they have baliffs on thier case too.

 

You are a lot more likely to get a quick settlement.

Ok, I've just logged on to MCOL and the "Start Judgement" button is gone and in the "Claim" section is says "Defence (28/11/06)" and this

"You are unable to take any further action online on this claim.

 

The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly."

This makes me slightly nervous. Could someone please just explain what this means, and/or what I should expect?

The idea of going in to a court room seems a bit daunting!

This is exactly what I have discovered today - except mine is dated "defence(29/11/06)". I haven't heard anything from either the courts or from DG solicitors so am getting worried now as my claim is for £1500 total so is not massive.... if you hear anything please could you let me know too as we seem to be in the same boat here!
