      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All this is my first post, I have just got papers from court with a defence from Yorkshire/Clydesdale bank, they are saying I got the bank name wrong on the claim and that I abused my account and will not get any charges back can anybody tell me Have I lost allready any help will be appreciated thanks in advance :confused:

Can you be a little more specific so we can answer ?

What Bank name did you put on the claim form ?

Regardless of the address as they have responded so must have got it.

Thanks for answering I put Yorkshire Bank PLC on the claim because when I put the post code in that was the name that came up, I explained this when I took the papers to court and they said it would be fine even though it didnt say PLC on any letters

Ok you should be fine nothing to worry about.

Plc added or not added or not should not be a problem.

Thanks Martin I really am grateful for any help I am trying for just under 5 thousand (havent got a pound sign ) never done anything like this before bit of a defeatist but changing slowly thanks again Merry Christmas and a Happy New Year to all XXXX

Hi again Could anybody help with filling in a court allocation questionaire I have to take it to the courts before 2nd Jan, also I need to pay another 100 pound (I paid 120 when I filed the claim ) is that correct????? I know its worth in in the end I would just like confirmation that this is correct:confused: many thanks x x

The Allocation Questionaire fee is £100 for a claim over £1500 so yes it's the correct fee. It's also reclaimable.

Hi all

I have just got a letter from the court - Notice of Transfer of Proceedings--They have switched from Newport to Cardiff is this ok I am a bit nervous as its getting serious now an is there any help out there if I have to appear in court I am rubbish at defending myself thanks in advance x havent got a clue what they will ask or expect me to know

They have either moved it closer to you or into a nearby court to relieve pressure at Newport. This is nothing unusual so dont panic.

 

I am sure that when the time comes (if it comes) somebody that lives close will buddy you on the day.

Hi again

 

The transfer of courts is nothing to worry about and as for defending yourself in court I think you misunderstand.It is the bank that are defending themselves in court and believe me they are a lot more scared of any of the cases actually going into a court room than you are. The Yorkshire Bank will offer you several settlements before it reaches the hearing date , but stick to your guns until you receive FULL settlement.We are with you all the way even if it ever did go to court there are lots of people on here more than qualified to attend the hearing with you(but trust me it will never get that far)

Seems to me you're doing just fine. The more you read up, the more familiar you will become with the process and then you'll feel much more confident. YB will do their best to put you off and worry you, but we'll all try to help.

Hi All, Thanks for advice on court bundle, I have got everything I need except

Caro I have recieved an offer from yb today of 4391.50 this includes court costs but no interest which when I calculated at offset of claim where 1324.45 should I hold out or accept and if I decide to hold out will the interest be more this has been going on since July last year

I have merged your threads and moved your posts from my thread to your own to make it easier for everyone to follow your progress and mine.

 

As long as you included interest in your Particulars of Claim, hold out for it. Much as you don't want to go to court, believe me YB are even more reluctant. You will need to be very firm, but you can get your interest, and if you asked for it at a daily rate from the date of your court claim you can get that too. It will probably go right to the wire, it will be nerve-wracking, but it can be done. Don't let YB keep one penny of your money, and make sure they don't forget the AQ fee too. If you haven't read it yet, it might help to read the latter stages of my thread in the YB/CB Successes forum. They are beginning to get the message that we will not be bullied into submission.
