      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can someone advise if i can submit a claim for my Current Account and Credit Card together as they are both with the Clydesdale Bank? I have all my statements from both accounts but not much to claim on my Credit Card but more on my Current Account. I also wondered if i can go back further as i have statements going back 10 years?

I am claiming from BOS for credit card and current account but I decided to split them as they have different head offices. On the claim from the last 10 years if you have the information and have not already requested payment then you can but remember you will have to argue the case to get past the 5 year limitation in Scotland. If you have already requested payment of charges then resubmit the letter with the new dates and charges stating that this letter supersedes my letter dated xx/xx/xx in bold print at the top of the letter.

Thanks for that, I will claim for both at the same time as the address I requested the Data is the same for both. I have gone far back as 1998 but are you suggesting it is harder to claim for this? I was under the impression if I had the statements I could include these?

I'm not suggesting that you can not claim but the defence from the banks will be that you are outside the 6 year limitations act or 5 year for Scotland but people are now trying this. I am also claiming further back than 5 years but following a conversation with the bank today I fully expect to be going to court to argue this case.

hi peeps, new to this..sorry if i ramble on lol

anyway, im looking into claiming bank charges from a clydesdale bank,i dont have my last 5 years statements,so i guess thats my starting point.# from my branch. what i dont know is that once i have my information together, where do i send my first letter to reclaim the amount of charges? do i stick with communicating with my branch or do i send my letters to the head office in glasgow??

As i am only getting started i need all the help i can, please help

I have now received a letter from the Clydesdale Bank telling me that is is up to me, e.t.c. They have also advised that this is the end of the matter. It has passed 14 days so do I now submit the Letter Before Action. My concern with this is that the letter seems to have been written in the way of no response from your Bank. Do I still submit even though they have stated they will not refund?

I have now received a letter from the Clydesdale Bank telling me that is is up to me, e.t.c. They have also advised that this is the end of the matter. It has passed 14 days so do I now submit the Letter Before Action. My concern with this is that the letter seems to have been written in the way of no response from your Bank. Could you clarify what you mean by the underlined bit? I am going to be raising a claim with CB as well and have sent away for my data (complete with cheque).

 

Are they telling you it is up to you to gather the information?

The reply from the Bank was that it is up to mr to keep my account in order and they will not repay the charges, that is what the underline section means. You send the S.A.R - (Subject Access Request) form with your £10 fee and they will supply all your statements within 40 days.

I am now at the stage that I need to obtain a Court Order against the Bank. Am I right in saying I will be able to goto my Local Court and obtain the documents I need, take them home and then go back to the court to submit my claim?

How much are you claiming? Upto £750 it is small claim form you need, between £750 and £1500 it's summary cause which carries more of a risk, over £1500 it's Ordinary action which means you would be better getting a lawyer, but if you have access to an English address the small claim limit is £5000.
